I recently applied under 0213. I agree process is not as complicated as it sounds also I am not sure what value add a lawyer will do apart from keying information from you in the forms. My suggestion - do it on your own. Use this forum Skilled Worker / Professional Immigration (http://www.canadavisa.com/canada-immigration-discussion-board/skilled-worker-professional-immigration-b4.0/)

and this step by step guide
    http://www.cic.gc.ca/english/pdf/kits/guides/EG7.pdf

Can you please provide the reference through whom you applied? I thought 0213 category is not eligible anymore.

To answer your question Yes nuthing gets transfered. Every time its a new h1b there is no transfer of anything. You can have 2 or more valid approved petition from different employers but you can use only one at a time.

Pay - They are liable and USCIS can question them. All they will have to do is show that this employee (OP) was no show never joined the company so basically agree with you here.

I was also under the same assumption. But I came to know that you can work for more than one sponsoring employer at a time.

It does make sense that the overflow numbers are given to higher preference categories in single state oversubscribed countries. When you think about it, will that not be the most beneficial to United States? Who would you prefer .... and Unskilled professional from a ROW category or a skilled worker from an Oversubscribed country. I would gather it would make more sense to give the opportunity to the higher skilled since the benefit to US will be higher

The more I read this form, the more I become disgruntled with this community! To say that someone from a lower class of visa and not from an "Oversubscribed country" (and I am assuming you mean India) is less skilled and less deserving than someone from a higher class and oversubscribed country is ludicrous to say the least. Each and everyone of us (and I mean "legal immigrants") have our own skill sets and contribute equally to the American society. As long as we are competent at what we do, then we are all SKILLED in our own way. The only real defining difference among the visa classes is the level of education not skill. To suggest one is better based on education alone is arrogance and nothing else!

The U.S. immigration system is not without its flaws and despite the delays and frustrations, it is FAIR! The per country limit is to ensure that citizens of ALL nations have an equal opportunity to immigrate to the U.S. and not just a select few. The only thing that I have found unfair as far as immigration in this country is concerned is the politicians' focused efforts to do something for the "illegal" immigrants at the expense of the "legal" immigrants.

We are all in this together and the insults and innuendos that dominate this forum divide us so let's stop them and focus on the real issues!

I have been to the indian consulate couple of times and what I have seen so far is that people staying in the US take the consulate officers for granted.

People take the token and start filling up the form in the consulate itself, they will be at the window and will be pasting photograph or filling up the form itself on the counter.

I think the consulate officer should ask people that will you behave the same way at an US consulate??

People become impatient just waiting for 10 minutes as if they entire indian consulate has been waiting for them to show up at the office.

The way we Indians behave boarding a flight in US, the same does not happen in India. The way we behave with the consulate officers at Indian consulate does not happen at the US consulate. Why do not the same people trying filling up the form at the US consulate or try pasting photograph and even run to grab the original when they are at an US consulate.

We want the same level of professional at the Indian consulate then we need to show the same level of professional at Indian consulate that we show at US consulates.

    Regards,
    Deepak

The other issue with sticking onto the current job is that the employer (if big corp) has a clause that says that you cannot work on any tech that you use in your job, external to the company. "Conflict of Interest" etc.

Open Source is a good avenue for IT people to keep their skillset current while doing good to the community.

Thats right, eventually when the H1B emploee gets Employement Authorization through GC process, the H4 spouse automatically becomes eligble to work and have better opportunities than any H1B holder. Why can't a H4 have a work authorization same as J2 or L2 or E2. Does ImmigrationVoice considered this thought and thinks as a good point to raise it to the senate in one of their efforts?

    One more question.

Where do you file if you are filing at the Texas Service Center?

    It says:

    USCIS Texas Service Center
    P.O. Box 851182
    Mesquite, TX 75185-1182

However Fedex/UPS will not deliver to PO Boxes. So does that mean we can send it ONLY via USPS?

I finally got the letters and the root cause of my I485 denial. My previous employer informed that they used my approved I140 for another employee. As many of you might know this I140 substitution practice was a loophole until June 2007. These days companies can not do this any more.

So probably when my I485 came up for adjudication, there was no I140 since it had been used and hence they denied it. Now, I changed jobs per AC21 rules--yeah the famous rule that USCIS ignores. I am waiting on my current attorneys to file an MTR as soon as possible.

    Question to forum members:
    1. Are there folks in EXACTLY similar situation?
    2. If yes, after filing MTR and it getting accepted, what are next steps since one definitely needs a approved I140?
    3. Further to #2 above, does one need to file another I140 and port the previous date? I am sure this would take longer time than the current H1b that I hold until June 2009.
    4. Can any one share lawyer name and contact info who might have favorably helped a forum member so that I can contact the person and get a second opinion to discuss legal strategies that might be available.

    Best-
    Mohican

    Yes. Completely agreed.

I've an idea that I want to discuss at the Meet. It will not only help us show the World how much we contribute (real figures), but also get our group (state chapter) legitimacy in the eyes of Lawmakers. It also might get us some media attention. This and other ideas will be Exclusively premiered at the Meeting. So anybody interested, be there.

Anybody with great ideas - FIFO for GCs, Earned GCs (based on years in US) included, be there at the meet. We'll surely forward these ideas to the Core. If there's a great demand for these ideas at the grassroots, Core'll surely include these as their top agenda. So be there and share your ideas. Ideas will be put to vote and passed on to the Team IV. It's a great opportunity to network with like-minded individuals and push for your ideas.

You are being given a rare and valuable opportunity here. Use it! Don't crib later on IV forums that IV doesn't care. [ I'll be there, for sure, to ask you - Did you care about your state chapter meetings? If Not, why should we care for you?]

PS : Bestin, same here. Lets build a strong network in Michigan and succeed together.

    Guys,
We also need to make the public aware what we contribute to the society. Not only our jobs, but also how we contribute to ssn, work without unemployment benefits (when compared to citizens),how much taxes we pay, etcs tatus of h4 dependents without driving licence and with all these stress we also do our job with a smile isnt?WE DEFINITELY NEED TO OVERCOME THE PUBLIC OPINION THAT WE ARE JUST HERE TO TAKEAWAY JOBS.

Rather than mentioning it as our right,we need to make people aware of how we contribute and why we deserve a green card.;)

    My 2 cents.

BTB,nice taking to u over phone WD.

    Hi,
    1. I am on L1 with current company A(with current i-94 expiring in Nov 2007). I got my H1 approval this year from consultant B and they got the I-797B. This document shows the validity from Nov 2007-2010. But I have heard people get something called I-797A which has a new I-94 attached to it and in my case it is not.

    Here are my questions.

    1. Can I start working for consultant B from Oct 1.(after quitting the company A with L1).?

    2. What should I do since I have current I-94 only till Nov 15th 2007 and if I ask my current company A to extend it they wont do because I want to leave them as early as possible before Oct 1st.

    3. Can my consultant file for the change of STATUS from L1 to H1B(the approval for which I have already received from USCIS) and then in that case it will have new I-94 attached.

    4. Anyother suggestions what should I be doing so that I can start working on H1 after Oct1st here and then whenever I go back to India, after 4 or 5 months I will have the Visa stamped.

    Thanks in advance.

You didn't specify if it has been 6 months since you had 140 approved through company A. Assuming it has been over 6 months (so company A won't revoke your 140), you can file for 485 and use the LC+140 of company A. You do not need an H-1 with company A as employment based GC is for future job not present job. The only risk involved is, if you apply for 485 which you are employed by company B, and if you get approval within 180 days (which I highly doubt) then you HAVE to go and work for company A for 90 days. If nothing happens for 180 days, you are safe.

Hope this answers your question. Anyone, correct me if I am wrong.

Does any one has any Idea or back of the envelope calculation as to how many EB2 visas (for all countries) may be left for the remainder of FY'07?
The reason I am saying Eb2 all and not EB2 India, as most of the 485 applications filled in early July 485 were from India. Hence, given the new interpretation of visa overflow, almost all will be assigned to this category.

You will be a free bird in INDIA only. All developed countried want you. They want to use you. They want to contain you. By getting India's resources, they deprive INDIA of their own skilled people and they also "contain" the growth of those people. What a masterstroke. Neither you win nor India wins. This is nothing but a sophisticated 21st century slavery.

Alterego, what great news! You WILL NOT REGRET coming! I totally agree with everything you say! At least we know that we will have stood up for our rights and we will be proud to tell our children that we did so!

Besides, you are absolutely right. This country takes notice when people speak up! The problem is that that's not the case in our birth countries, and thus we are not hard-wired to speak-up! But if we make an effort we will definitely see the results! When people speak up and make a case for their basic rights then they are given those rights! But the rights will be taken away if we give them away, and the way to give them away is to remain quiet! This is a country where the fittest survive, and people will take what is yours if you do not claim it and/or protect it!

We will make our voices heard, and we will end retrogression! But we cannot do it without us all joining together!

I think we can do it, now just decide if you want to be part of history or not. Think if you want to remember this action for the rest of your life, or maybe you will regret you didn't spend one day out off the office. I sure want to be there!

..from any single state, afaik (perhaps with the exception of NJ, don't have the exact numbers - but in stark contrast to many other states... ).

Also note, the attendance at short notice for the SJ rally was phenomenal.

Let's just say Californians are more motivated and active then many from the DC area, and you can expect an even larger crowd the next time around, with better planning and more time imo.

    jazz

Jaime, your thought of having one more rally in Silicon Valley is a good one but again you are going to have the same crowd..!!
People in neighbouring states of DC did not make it , you tthink they will make it all the way to west coast! very doubtful!!
We should aim at bringing in more people to this family as possible..
Looks like a simultaneous rally on a weekend will be very effective!
And this time for the rally we will carry one one slogan banners
'SHORTEN THE WAIT FOR LEGAL IMMIGRANTS' or something similar!
    just a thought!

Forming human chain may involve actually holding hands.. and might turnout to be unhygienic to many. How about hunger strike - for a day or two - and it is also good for health. A better option would be -DONATE a day's salary to IV on a particular day..I am in for it: Nov 9th?

I am not being jsut sarcastic here: just curious to know, of the 20K+ people who had directly benefited by IV between July 17 and Aug 17, how many were there in the rally? July fiasco is the one that has made many immi community professionals to look up to IV mainly because PEOPLE directly benefited from IV's efforts. Still it would be worthwhile to analyze the response and attitudes of IV users/members in general, and fiasco beneficiaries in particular, before getting carried away by the euphoria of the moment to plan for rallies in state capitals, SFO etc.

Just because you can go on a city's roads with permission, does not mean that you should do it compulsively nor over do it. SJ and DC rallies made the point: caught the media and lawmakers' attention. Do one every month, then it will be a joke.

If you have not yet understood the importance of IV, now is the time to ACT.

    About IV:
    http://immigrationvoice.org/index.php?option=com_content&task=view&id=5&Itemid=35

    IV's achievements summarized by Macaca
    http://immigrationvoice.org/forum/showpost.php?p=181953&postcount=216

Start participating in your local state chapters. If there is no state chapter, please start one. Please see my weblog for guidance:
    http://anilgeneral.blogspot.com/2007/10/how-to-start-and-maintain-state-chapter.html

Still not convinced that IV has the leadership, look at this picture of Jay in front of the capitol during the IV DC Rally:
    http://anilgeneral.blogspot.com/2007/11/iv-is-this.html

Want to see some DC rally pictures:
    http://dcrally.blogspot.com

    IV has its own blog:
    http://immigrationvoice.blogspot.com

Look around. An IV meet up may be happening in your neighborhood/city.

While most of you were tracking your receipts, FP notices, EADs and APs, IV was working relentlessly to achieve its sole motive: "ERADICATE RETROGRESSION"
The irony of the current state of affairs that it is a long struggle to achieve the motive. We need your support at the grass roots level. "Are you upto it?". As Gatorade says, "IS IT IN YOU?"

"The Time is always right to do the right thing" -MLK,Jr.

I have an EAD, what can go wrong now?
Well, continue to pay $1K per person for EAD/AP every year until you get your GC. You will never have peace of mind that comes with a Permanent Work Permit aka GC.

    How do I contact IV?
Contact any of the IV active members and they will direct you. A simple PM is all that you need. Some of the members you can contact are pappu, logiclife, paskal, chandu123, janilsal,needhelp,english_august, franklin.

    Telephone: (202) 386-6250
    EMail: info AT immigrationvoice.org

    Thanks for putting it together.
