    Good news for some and not so good news for others. I have been waiting for my labor for last 4 years and have still not got the approval on hand. So I am not ready to apply for 485. Where as a friend of mine who came to US last year and applied for labor through perm 2 months back has his approved labor and can apply for 485. I feel this is kind of unfair. The dates should have progressed slowly but steadily instead of trying to create a mad rush now.

    I am a Person of Indian Origin. I have a slate-grey passport-like document issued by the Indian government that says so. But I�m not really. I was not born or brought up here, and I do not have a single direct ancestor who, as far as I know, ever lived in India. I have become the proud possessor of a Persons of Indian Origin card because I am married to an Indian citizen.

    I had lived in India, on and off, for ten years�and had been married to an Indian citizen for even longer.
    Two men were seated at the edge of the sofa, looking more nervous than me. Shireen was questioning them.


    Previously, my visas were renewed every six months. We now wanted to stay in India indefinitely and make our home in Delhi. I would have preferred dual citizenship�but that wasn�t, and still isn�t, available. PIO would be second best. But the actual card was not easy to come by. It involved a total of 17 visits to three separate ministries and five different offices. It took up at least four full days of my life. I was interviewed twice, the second time at home with my wife, Shireen. The first time was at the offices of the Foreigners Division, Ministry of Home Affairs, in an unventilated, very public room brimming with non-Indians from every continent. I reached the head of the queue after two hours of eavesdropping on other people�s immigration problems. I was asked, among other more prosaic questions, to explain why I had married an Indian woman (�Love,� I said, monosyllabically), and then, with a leer and a twinkle, whether I had had many Indian girlfriends. �N-no�, I stuttered. My hesitant response did not reflect either uncertainty or mendacity on my part, but my surprise and my growing irritation with the questioner. The interview ended abruptly. He wrote �Refer for further enquiry� on my residence permit and said I would receive a home visit. �We need to be sure that marriages to Indian citizens are genuine.�

    Several weeks later, one Friday afternoon around 5 pm, I received a phone call as I was pottering around the streets of central Delhi.
    �He wanted a bribe, you idiot,� my friend said. �You�ll never get your card now; he�d have been happy with Rs 100.�


    The investigators from the Home Ministry would be at my home at 5.30. As I rushed home, images of Mr and Mrs, a television programme of my UK childhood, flashed through my mind. A gormless husband would be placed in a soundproof booth, while his bright-as-a-button wife would stand on the stage. She would be asked semi-intimate questions about their life together: what was the first present she gave him when they were ? What colour nightclothes was she wearing yesterday? And so on. The husband was then released from the booth, and would invariably get the answers wrong, to his embarrassment and everyone else�s amusement. It was gentle viewing�a mild celebration of female omniscience and male autism. But now I was going to take part in a real-life version of Mr and Mrs, and my precious PIO card, and perhaps my right to stay in India, would depend on it. And, suddenly I could not, for the life of me, remember the colour of Shireen�s toothbrush, or the name of her favourite Hindi movie, or her shoe size. Fifteen years of marriage had been erased from my memory. I was sweating with nerves by the time I reached home.

    Two men were seated on the edge of the sofa, looking even more nervous than me, untouched glasses of water in front of them. Shireen was questioning them about their professional qualifications�which were not very extensive. I gave her a self-conscious kiss on the cheek and sat down. At that point, our children burst in, a dancing duet of carefree excitement.

    �What are these children?� asked the chief investigator.

    �They�re ours.� Shireen responded with a slight chill in her voice.

    �Children of both of you? They are very old.�

    �Yes, both of us. They�re twelve and eleven.�

    �How do you have children if you are just married?� I had not prepared for this baffling line of questioning�and was later reprimanded for just sitting there with my mouth open. Shireen, meanwhile, delivered a crushing blow.

    �Ridiculous (sotto voce).... This is all totally ridiculous (out loud).... We�ve been married for fifteen years.�

    I nodded eagerly.

    The two men looked at each other, aghast, and then started scrabbling through the cardboard file they had brought with them. It became clear that they normally interviewed newly-married couples.

    �Can we see your marriage certificate?� I showed it to them and was asked for a copy. I printed out a copy of the certificate, which was downloaded on my computer. They then got up and left�abruptly ending my brief cameo on Mr and Mrs�having promised a decision within two weeks.

    The following evening, a Saturday, our cook, Pan Singh, said one of the men who had come yesterday was at the gate, asking for a lifafa, the Hindi word for envelope. I asked him to invite the man in. Pan Singh returned, a little sheepish, saying the man refused to come in, but just wanted a lifafa�with our marriage certificate. And so, slightly puzzled, I printed out another copy.

    Later, I told a friend this story. �He wanted a bribe, you idiot. A lifafa is what you put the bribe in. You�ll never get your PIO card now, and he�d have been perfectly happy with 100 rupees.�

    Three weeks later I went to the Foreigners� Regional Registration Office to hear the good news, and the bad. �Your application for a PIO has successfully passed the enquiry stage,� the official informed me without looking up. �But unfortunately, Mr Miller, all your documentation has gone astray and you will need to resubmit.� I looked heavenwards and brought my hand down rather heavily on the table. �I�m sorry. We�re not computerised yet, and some of our agents are a little careless.� It may have been my imagination, but I�m sure I detected the trace of a wink in her left eye. �Probably best to apply next time you�re in London,� she told me cheerfully. I walked away presuming, but unable to prove, that my papers had been deliberately lost.

    I took her advice. Three weeks after putting in my application to the Indian High Commission in London (no interview necessary), I had my precious PIO card�together with a 15-year visa, the right to buy property in India, and, to my amusement, the ability to join the diplomats� queue at immigration at Delhi airport. This is of no practical use, because I still have to wait just as long for my luggage, but I do get childishly gleeful as I saunter past the first-class passengers.

    Those who do talk and blame in the anonymity of the web andnever do anything and keep hiding behind their closets expecting sky to fall are the one who "don't wear clothes"

    Folks - in all seriousness - why don't people come out of anonymity? Are you shy? Are you scared? I know, you don't come out because you don't wear any clothes.

    Things are bad for us - let us not blame IV. Utilize this time to mobilize the community. Lets build IV stronger. Lets build state chapters, lets all unite and do something about it.

    IV members have done a lot of things and keep doing things - the reason we see no result or minimal result is because the community has never never come forward to help. It has been a very few folks that actually did something.

    How long ca you think a few people can do everything for us? Should we all not take one step forward in helping ourselves?

    We don't. We want to sit behind the anonymity of the web and blame a scapegoat. Those who want to help are scapegoats. Blame IV - for everything.

    The reality is - IV needs a lot lot lot funds,IV needs manpower, IV needs your skills, IV needs your unity, IV does not need your criticism because if you criticize IV it won't help you.
    So you and I together - united we stand - we build IV - if we do not want to take that extra step - we all suffer.

    Some of us spent a lot of money - we did rallies and lobby days - shelled a lot of money frm our pockets - what else can you expect us to do? why did you not do rally or why don't you participate lobbying. why don't you talk to media, why don't you collectively network for the cause?

    Admin fixes - some members were begging in train stations to get signatures on the admin fix letter. People waited outside places of worship, parties, schools, and other places, they were ready to s[pend money and time on these things, but why did 30K + members not want to even sign the admin fix letter.

    Members are running marathons for IVs funds - some members are travelling to various cities to run for fund raising

    One extremely dedicated member had a fast food stall during a festival and donated all the money to IV.

    A lot of us have suffered with getting wrongful denials when we used AC21 - we started a campaign - but it just never picked up - some hundred letters went out to USCIS - and were ignored and we still see the same thing happening.

    How much can the same people keep doing things again and again. We do need more help. IV is nothing but you and me and all of us.

    For folks who are not happy with the visa bulletin. here is the reason why dates are not moving forward. USCIS are getting approvable cases with older priority dates and as they keep exhausting visas dates will not move forward. How the hell can USCIS get cases prior to 2001 ? The sad reality is - there are many cases - they could be "future employment, consular processing, labor subsitution, straight cases, cases lying withiout being adjudicated for various reasons ...... " as long as USCIS can get old cases to approve, dates will not move forward. If USCIS is sitting idle with no old cases, then DOS will move the date forward.

    How can we resolve the above? Infighting won't help. We must unite and get our issues resolved. We must work towards admin fixes, we must work towards recapture, we must work towards other positive things that helps us.

    Are we ready for helpingh ourselves? Lets stop infighting. Lets all join hands and help ourselves. Can we?

    We need some new generation members who can help us. Let all members pledge - we are all united - we will come out of our shelles - we will not do infighting - we will not blame others for issues tht we all face

    Remember what Mahatma Gandhi said " Lets not blame others for weaknesses we all possess"

    Here I want to make clear, FIFO for taking labor applications and sending ad instructions not for approving. I know depending on compilcation of cases(I think), some cases with PD 2005 get approved fast and cases with PD 2003 are taking longer. I dont know why all these mess in DOL, for taking the labor applications and sending ad instructions.

    No, I don't think it has anything to do with complication of cases. I know of the two different employees with the same employer with similar jobs/descriptions, one with PD 2005 approved and another with PD 2003 whose application hasn't even been taken for processing. So the behavior of the BEC just seems to be random and there seems to be no particular logic. Complication of the cases is definitely not one of the reasons as far as I know.

    I am sorry you feel like that about IV core. I am not a CORE member so I can't speak for them but if you have spent a basic amount of time following and more importantly taking part in IV initiatives you would not have "decided" that IV is promoting "EB2" agenda simply because there is no such agenda.

    I am sure you noticed this but if not, this is a free speech and membership forum and IV is not made up by pappu or paskal but each and every one who tries to make some difference by participating in the action items.

    If you think that there needs to be IV initiatives that better suit your needs, you know what...lead it...set up action items....organize like minded folks. IV is setup for that. It is easy to just point fingers and put out statements based on your negative perception, if you really feel so bad about this phantom EB2 agenda, how about doing something constructive through IV.

    ask a EB3 person if he was happy when EB3 was available and Eb2 was not.
    Did any one try to justify the reason why EB2 was UNAVAILABLE? No.

    Did anyone here feel unhappy that EB2 moved so nicely? No.

    Then why are we not seeing a single post from anyone which says we as aspiring immigrants are not being failrly dealt with when EB3 did not move with EB2.

    Instead we see posts about why EB3 is not moving and explanation of reasons behind it.

    Is there a hidden agenda here, NO. Not from IV, am i trying to prove something like that? I dont think so.

    Got it yesterday...

    1 year EAD + validation from the date of approval, so basically lost 3 months of my current EAD.

    How long do you have to work for the employer??

    If your GC is based on EB-1 then it would be self petition and not based on employer based petition (EB-2). In that case you don't have to work for the employer after GC approval. Clarify with your attorney though.

    If it is an IBM 3270, 5250, etc mainframe it still wouldn't take that long.
    Let me take it a step further.
    If the information is stored as a segregated flat file, it won't take that long.
    One could just proxy a perl/java gateway and write a script to parse data.

    Who does it.. makes all the difference.


    Those of you who are thinking that you can write a SQL query in a snap, you are egregiously mistaken.

    The CLAIMS database, which contains the AOS/485 petitions is neither a SQL database nor a modern CRM application. AFAIK, It is a legacy Mainframe system and needs significant effort and rare expertise to extract the data.

    Ideally, The Country of Chargeability should be in there. But these systems were built around 92 or before and the requirements gathering probably might not have thought about retrogression or carelessly left it out. What ever it is, it is not in the electronic format, it is almost impossible to get the biographic information unless a physical check is conducted. We can cringe and cry all we want, but not a lot is going to happen on the CC

    The good side of the issue is, Since EB-3 ROW is beyond 2004 and we have per country PERM data (not completely accurate, but significant), our statisticians and operations research folks will break down both data and get some thing that is valuable and accurate above 90%. We can safely assume that more than 90% EB-3 Pending before 2005 belong to I, C & M.

    What bothers me is the requirement of the definition of Priority Date? You would expect some one in the CIS/NRC to know what a priority date is. Don't ya? Any ways, We are working with members who received the response to get a better answer from CIS to determine further action.
