    "Less number of attendees" had a big impact in our minds and it sidelined one of the positive outcome of the meeting and that is outcome of Q&A with the Guest.

    Guest answered many questions personal - EB based immigration and other immigration but in my opinion we could get very precise answers on following questions raised by attendees in more clear manner without leaving any doubts and ifs and buts.

    Q:1 What need to be done if one has different "A" numbers on I-140 and 485?
    Q:2 Age old confusion - Using AC21 after 180 days - How to use it.

    AND WE ALL COULD GET VERY PRECISE ANSWERS IN A VERY PROFESSIONAL MANNER FROM A WONDERFUL GUEST(Attorney) AND THAT WITHOUT PAYING HOURLY FEE.

    I have not received the Receipt Notice yet.
    On the back of the cleared check, I see some numbers but not sure which is the receipt no. Does it start with LIN followed by 10 digit number? Or, is it 12 digit number with no letters?

    A) LIN followed by 10 digit number

    Something like LIN 07 XXX 5YYYY

    LIN = Nebraska Service Center
    07 = Fiscal Year 2007
    XXX = Number of computer days since October 1, 2006
    5YYY = CIS control number

    When I called them up-She said USCIS has not decided anything whether they will accept or reject anything-Whatever it is within 15 working days if we receive receipt then we are ok.Whatever the bulletin shows.

    So lets wait and see.What ever theyd ecide will be known in 15 working days .So atleast they will start something in 15days.

    Well this is an unfortunate development nevertheless it brings closure to months and months of speculations and hope for us. For past one year IV has provided as with a forum to fight for a our just cause and brought together all of us like minded individuals. I sincerely thank IV for that and doing countless things beyond what they have signed for. This has been a hard fight full of down moments but all in all it was a worthy experience. I guess we are at a juncture where I get the feeling despite our hard efforts to distinguish ourselves based what we are and what we represent, there is a growing consensus to tie us with what we don't represent. To me giving us what we are asking for, ONLY when they will print 12 million+ Green Cards for people who have falsified identities, carried no driver's license and have fled to America to fight hunger and poverty is an insult to what we have fought hard to achieve in life (education, career etc) in past many years. I have seen numerous stories on IV forum about folks who struggled to renew driver's license at DMV's and that's just tip of the iceberg I can go on about the struggle each one of us has faced to keep legal status amidst recessions, job loss, insanity of DOL, USCIS and many other hurdles. I don't have much to say except that the next step to achieve our goals is a conflicting priority. At this point I feel that there is no need to educate people who choose to be ignorant. I will sign off now !!! I wish good luck to IV and Thank IV core for doing more than what they have signed for.

    ..from any single state, afaik (perhaps with the exception of NJ, don't have the exact numbers - but in stark contrast to many other states... ).

    Also note, the attendance at short notice for the SJ rally was phenomenal.

    Let's just say Californians are more motivated and active then many from the DC area, and you can expect an even larger crowd the next time around, with better planning and more time imo.

    One reason for the poor performance from DC area folks is that a GC does not open many avenues for folks in DC area. You could change from a 70K job to 90K job, may be. In Silicon Valley there are many more opportunities. You are talking about a change from 80K to may be starting a million $$ company.

    if you can get letter from employers/H1B application that you worked as PM then you can apply. Also I think the work has to be within certain years

    I understand your concerns that if there's a huge crowd, nothing will come out of it, in all the din created by the crowd and everyone throwing their suggestions.

    Right now the question is hypothetical as we don't have a overwhelming confirmations of 100+! Even a crowd of 25 is okay, if we can reach that number. Since this is the first ever MI level meet, I will be surprised (and happy too) if we cross 25-30.

    If it's 100+ a new level of pre-planning will be necessary. Our leaders ( cagedcatcus? chintu25?) will need to book a hall, set a clear and focused agenda (so that we don't lose focus), get IV core to address us by telephone/speaker phones, they can even persuade an Immigration attorney (trying to reach out to future clients) to address our questions etc.. It will be a different ball game! It can be handled effectively without limiting numbers.


    I think for first meeting 10-12 are enough. Let us meet and decide upon the strategy to have more people. I would prefer not to have lot of people in the first meeting.

    is not so good. i would not recommend anybody to this law firm. they do not answer promptly, they do not reply your emails. the phone always goes to voice mail. horrible guys. but one time for H1B extension they did good work.

    Advantages of applying AOS when PD is not current
    1. No H1 extension needed (especially these days believe me its a nightmare)
    2. No visa Stamping needed (BIG BIG Night mare)
    3. spouse can work
    4. Dont have to worry about LCA blaw blaw blaw. especially after seeing the recent arrests
    5. during layoff do not have to start GC process (in this case AC21 can be used)
    6. WE CAN CHANGE TO EAD WHEN ANTI IMMIGRANTS CRY ABOUT H1 AND IN THIS ECONOMY DO NOT SURPRISE IF H1 IS COMPLETELY SCRAPPED.
    8. Can do two jobs at a time (in this economy its difficult, but this is possible if you are using EAD)
    9. You can work for TARP Companies (There are about 360 bail out banks... so you can work for any of these banks if using EAD)
    10. BIG ADVANTAGE... IF YOU ARE APPLYING EARLY IT IS VERY MUCH POSSIBLE FOR DHS/CIS TO DO ALL THE BACK GROUND CHECK/NAME CHECK WELL IN ADVANCE. AS AND WHEN A VISA # IS AVAILABLE, IT CAN EASILY BE ASSIGNED TO THE APPLICANT. THIS WAY CIS CAN BE EFFECIENT AND WILL NOT WASTE VISA's

    Again I do support others who say that AC21 job titles clause should be relaxed... All I am saying is one step at a time and more over there is a compaign already in progress.
    ALSO numbers really matter. There are lots and lots of my friends who are using AC21 with out any problem.

    I'm hoping this does come through. This is a great step and I'm surprised that the Secretary brought this up on her own. However, hydboy's point is true. This will be most useful if AC21 is honored by USCIS. Kiran's point about convenience for visa stamping doesn't move me. The biggest advantage of applying for AOS is being able to move jobs after 6months using AC21. Anyway, I guess it all depends on the numbers. How many people have had issues with AC21 versus how many have had no issues with AC21. Also in almost everything in life, the ones with negative experience will be more vocal than the the ones who've had a positive experience.

    Have a cup of coffe, it is sprint break time, I am taking my daughter out....also I am going to meet some friends over this weekend.

    This EB-2, EB-3, ROW, India, China..... only hurts me when I think about it! As long as I am busy with my day to day life.....life is beautiful.

    To the people that did attend, I re-iterate, please don't judge people who post their honest opinion. We should take this opportunity to learn why people choose not to come so we can improve our strategy for next time.

    India would be a good option for an Indian. For others I still think Canada and Australia are are the best options after US, in terms of standard of living, quality of life etc. It will take India decades more to achieve the same standards.


    I agree, India is a far better option.

    Assuming this discussion is about immigration/permanent-settlement and not about short term visits, work and study.

    On the side note, The only problem faced in india is over population which triggers almost all other issues. If india implements onechildpolicy most of the problems faced today will disappear in few decades. Your child (note: singular) need not leave india to enjoy international level lifestyle & benefits.

    As a backup plan to greencard advocacy we need to lobby the indian government to implement onechildpoilcy immediately.

    First thanks to those who put there first hand experience in this thread, it made me think again. And now I am deciding to cross the border and go north, after 9+ years in US on H1b.

    Could someone please refer a Do-it-yourself kit that they have used and/or immigration consultant?
    I contacted one consultant, they email almost every week and when I called/emailed them saying I am ready to pursue there has been no response from other side yet.

    It will be great help for me if you could refer a kit or a consultant.

    Looking forward to join H1->Canada community :D

    Do you have a valid AP ? If yes, you wouldn't have problem entering US on AP. Just show your valid AP at POE and they will let you in with a "congratulations". I know someone whose GC was approved when he was out of US. He was let in with his AP with no issues.

    approval when not current:
    Are you sure you never applied for I-140 on your previous labor ? Your company might have done it. There was a recent occurrence of GC approval where USCIS picked up on old dormant I-140 and approved an IV members GC when she least expected.

    Well...I am one of us stuck in EB3. I do qualify for EB2 but my employer choose to file it under EB3. I recently invoked AC21 and moved over to a new employer on my EAD. Is there a way I can ask my new employer if they can file new I140 under EB2 and change my category to EB2?


    Is it possible to file I-485 again (with older PD) after switching to new employer? Does AC21 rule allow this?
