There has been a change. It is starting in January.
We have a lame-duck season to get across. If CIR/SKILL bill is going to take time after Jan, let us get the smaller items in, until then.

Paying money for something that will give us results is fine (although I strongly feel this information should be free for whoever requests - that is the whole point of FOIA), but paying for something that has no commitment from USCIS to any date's is in my view throwing away money for their pizza parties or whatever else they do over there besides work.

Its only going to take 5 people to break away from the 64. Those 35 "No" votes are the ones who want CIR dead NOW. They are not going to change. But those 64, its only going to take 5 people to walk away.
There are 24 amendments. I think atleast 5 people would see their amendments fail on the floor of the house and probably another 5 atleast who would withdraw support because someone else's amendment passed. This baby is going DOWWWNNN this weekend per my estimate. I could be wrong but again, 24 amendments ? That's too many darts on a fragile compromise.
as far as i know Reid is smart about this thats why hes using the "clay pigeon" manuevre where all the 24 amendments would be tied as one amendment and then voted to pass on, once its passed then the cloture vote will come in (without the individual amdts yet voted on) once the cloture vote is secured then they will have 30 hours to vote all the individual 24 amdts after whc a simple majority vote ( min 51 votes) wud be needed to clear the bill...real smart

My colleague is EB3-I with priority date in early 2003. He is in the process of porting to EB2 instead of waiting for his date to be current.

hello,
during the july 2007 fiasco i applied for i485 and i got my ead and ap, but i have not used the ead and still using and maintaining my h1.
Here is my dilemma, 2 years ago i went to india and used my ap when entering us though i had a valid h1 but i did not get the visa stamped and after entering us on ap i am still using and maintaining my h1 and not using ead. Recently i also got a 3 year extension on my h1.
Now i am applying for my new ap as the old one is expired. My question to you gurus is what should i put in the "class of admission" field? Shall i put the aos or h1?

Hi All,
I came to US a week back and have realised that my consultant here is in-competent to get me a job sooner. He usually takes 2 months.
So, I am planning to get my H1 transfer with-out pay stubs. Some consultant are even ready to get that done.

Eb3 v/s Eb2 is a nonsensical nonproductive meaningless argument. If you actively participate in speaking with the lawmakers, you would know the bogus nature of this squabble. Each one of us has a choice. We can continue with this pissing contest or we could do something to fix the backlogs. We all understand the frustration and anxiety due to the long delays. It is easy to be drawn in meaningless eb2 v/s eb3 quarrel in the virtual world when one is not privy to how things work in the real world.
If you feel compelled to engage in infra and trivia, please utilize your energy for your benefit by understanding the larger debate so that each one of us can employ our energy to fix our issues. Please use your energy in a positive manner. There is no point of this discussion. It is easy to write/post arguments just to support your own application/position in line. Anybody can do that. But such narrow minded approach will not help even a single soul on this planet, including yours. For those of you who want to continue with this bickering, you can do so at the expense of your own time. And when you engage in such arguments, please remember that whatever you all write or post about this nonsensical back-and-forth is not helping you or your family. But if you are sincere and care for this issue, if you truly care for your issue, then please consider participating actively to meet with the lawmakers to make our voices heard.

Did anyone research whether it is possible to get some relief through rulemaking, instead of legislation? For example, there is no 'explicit' prohibition against issuing employment authorization to spouses of H1bi employees. The rule-making agency (in this case the DHS or USCIS) can grant a benefit that spouses be provided with employment authorization. Recently, the USCIS actually did provide regulatory relief by de-coupling the H1bi period of stay from the period of stay in H4 status. An idea to consider...

I am not sure about the statement "There is no corporate support for EB reform.....". Check this link http://www.competeamerica.org/. They seem to have the same agenda as ours (i.e., IV's). Is IV aware (or in collaboration) with them?

Maybe we need to figure out how we can involve the corporations in EB relief. The only reasons we see Schedule A relief every year because there is a strong health industry lobby driving this. the worst part about this is that these 90,000 and 50,000 which were released last year and they are trying now are comming from the unused\recaptured visas from previous years. there is no country limit in the unused\recaptured visas for Schedule A.

I have a pending I-140 since July 2006. Today i lost my sponsor employer and don't know what to do. Can I switch my pending I-140 to another employer? What can i do NOT to lose status? I still have a valid H1B till Augist 2008 but I have travelled on my Advance Parole. Does that mean that my H1B is terminated? Please advise. Thank you.

Too late in the game. Lets just finish up what we've started. I believe in go green (I pledged not to buy another box of ziplocs) , but if 25000 sheets of paper will bring me my fixes, I don't mind planting 20 trees to make up for it.

This letter has no mention of the problems regarding permanent residency, it only refers to the H1-B quota issues, we should contact the Congressman Shadegg to clarify that its not just about the H1-B, the problem also lies in the immigration process of skilled workers. If this is not part of his bill then we should urge(request) him to include this.

But you got to understand that if not for corporate lobbying (who have a heavier stake in H1-Bs) this bill would not have seen the light of day, that too in the house. We got to be thankful we are at least not being treated on par with the illegal aliens .. the broad theme of this bill is highly related to skilled immigration, which is much less controversial than granting citizenship to illegals; not withstanding the tancredos and numbersUSAs who will still be yelling doomsday from the rooftops. Granted we are flying under the radar as usual, but I very much doubt this will be an H1-B only bill without any EB relief.

If not, you got a lucky break, just cherish it? Once in a while USCIS gives us good surprises too:D Few of the folks don't have the guts to share such a lucky break on the forum, thanks for letting us know. EB2 visa's are available and hence the approval won't be a surprise except that u'r PD's aren't current. It would've been a huge surprise if this happened to EB3-I. May be the adjudicator mistakenly saw U as a ROW applicant. We all wish this adjudicator be assigned with lots of cases:D
