I thought IRS will allow you to withdraw your 401(K) with a 10% fine + all applicable taxes. Not sure how that will benefit someone who is forced to withdraw becuase he has to return to India.
You go back to India and withdraw one year later when you have 0 US income. Anything below 15K income is not taxable. Your 401 (K) withdrawal is added to your income for taxes

I don't personally think we had much media coverage except some hidden links, can we post some paid adds where everyone can get know what we are addressing in here i.e., on the front page of google, yahoo, msn, cnn, etc. I know some people might have second thoughts as it involves $ but I'm ready for it to get public attention. There is a thin line between legal and illigal and they are ready to club both together for their benefits. I'm starting to wonder how many people know what is going on, we have to educate them first.

As mentioned by some others in the same thread: a lot of employers are also taking advantage of this situation.
i was one of those who was forced to file EB3 despite qualifying very well for EB2. The pretext is job description, although same job description has personnel applied for in EB2.
Quite a few of the EB3 crowd has had no choice, but to be herded in the slowest category to benefit the employer.
How can we highlight this?
Only way out is to find another employer/manager, file an EB2 labor and recapture the old priority date. Once you have the basic qualifications (MS or BS+5), the decision between EB3/EB2 is subjective and at your manager's/employer's discretion.

But car rallies may not have as much impact as personal rallies! Car rallies will hold up holiday goers and this might not be pleasent..

Congratulations for all that fight for so long. I just can�t believe all EB categories are current.
Sorry for my inexperience of GC process. I am a newbie and have couples questions.
1. My husband�s LC is approved. Attorney is preparing I-140 (may submit it already), since the date is current. Does that mean we can apply for I-485 at the same time too?
2. Once submitting I-485, can we leave the country? We have to go back to home country for my husband�s dad pass away 1 year memorial. We have to make that trip, so should we wait until after the trip to submit I-485?

I am at the final stage,
my attorny just sent back my DS-230, and just got wait for the dates to br current.
so i can get the last bit at the embassy sorted, and yes i am doing CP, its my only option. and yes i do have all the rellevant experice and qualifications, i never would have got my i140 other wise.
it carnt stay at AUG 02 for ever. it will move, just got to see what happens.
Whether or not you have passed LC and 140 makes no difference on the wait time. I still say about 4 more years unless there is a change in the law. Sorry, I'm rather unfamiliar with the CP side of applications.
And Sunny1000 - no, you haven't missed anything
