Everbody's posts here are speculations on what USCIS will do ...
Geez.....you definitely need a brain check.
:D :D :D
Say at USCIS's "mid month" meeting, they are discussing the major points:
<conference call service> badoop! badoop! badoop! badoop!
Dr. Emilio T. Gonzalez, Director: OK, it is 11:30, everyone ready for our morning bi-monthly call?
Jonathan Scharfen, Deputy Director: I'm Here Dr. Emilio!

Lynden Melmed, Chief Counsel: Mr. Melmed, Esq., Present!

<conference call service> badoop!
Dr. Emilio T. Gonzalez, Director: OK, who is late! Who is it! Speak up!
Jonathan Scharfen, Deputy Director: I think it was Jeffrey! I got a virus last week and he..
Dr. Emilio T. Gonzalez, Director: Enough Jonathan!
Jeffrey Conklin, Chief Information Officer: I'm here. I was just instructing our IT staff how to reboot the talky thingy phone system.
Jonathan Scharfen, Deputy Director: You mean the "V.O.I.P. Call Center."
Jeffrey Conklin, Chief Information Officer: I know I was going to...
Dr. Emilio T. Gonzalez, Director: Enough Jonathan! I'm not inviting you next meeting if you continue this. Lets get started! Now Lynden. You there? What is that status of this class action suit? My girlfriend said I was wearing a "class action suit"!!
<all> lol!

Dr. Emilio T. Gonzalez, Director: Lynden! I've had it up to here with your dithering: Out with it man!
Lynden Melmed, Chief Counsel: Ummm... they might have a case sir.
Rendell Jones, Chief Financial Officer: What do you (ahem, this is Rendell) What do you mean a case Lynden?
Lynden Melmed, Chief Counsel: Well, it is just that in order to make our organization a profit center as per Presidential directive #232322, we did a little boo boo.
Rendell Jones, Chief Financial Officer: I want to state here and now that I advised against it!
Dr. Emilio T. Gonzalez, Director: Shut up Rendell!! Lynden! You make those foreigners and their case GO AWAY! That is our job, to make them GO AWAY! Don't you know that that is what we do here? How long have you been here Jones? Not much longer at this rate!!! Rendell! Were do we stand with this. It is July and the board has not finished our bi-annual bonus calculations yet. This smells like trouble. What are you going to do Rendell??? RENDELLLLL???
Rendell Jones, Chief Financial Officer: Umm, well the new schedule kicks in next month. We plan on holding the July applications hostage until we get them paying new rates.
Lynden Melmed, Chief Counsel: Can you do that?
Rendell Jones, Chief Financial Officer: You're the lawyer Lynden! You want your bonus or not???
Lynden Melmed, Chief Counsel: Oh. We,umm can't do that! Is that why we? Oh crap.
Dr. Emilio T. Gonzalez, Director: Rendell!!!! Was this your idea???
Jonathan Scharfen, Deputy Director: Yes it was! I saw the memo! I'll fax it to you if...
Dr. Emilio T. Gonzalez, Director:Jonathan, you're getting staticy, I'm disconnecting you. Call back later!
<conference call service> <badoop> "Scharfen, Jonathan....Disconnected."
Jeffrey Conklin, Chief Information Officer: There's nothing wrong with the v.o.i.p. system sir!
Dr. Emilio T. Gonzalez, Director: hmmmmph.
Jeffrey Conklin, Chief Information Officer: In fact we're really busy with that call center. Phones are ringing off the hook!
Dr. Emilio T. Gonzalez, Director: As long as they don't get my number!

Eb3 v/s Eb2 is a nonsensical nonproductive meaningless argument. If you actively participate in speaking with the lawmakers, you would know the bogus nature of this squabble. Each one of us has a choice. We can continue with this pissing contest or we could do something to fix the backlogs. We all understand the frustration and anxiety due to the long delays. It is easy to be drawn in meaningless eb2 v/s eb3 quarrel in the virtual world when one is not privy to how things work in the real world.
If you feel compelled to engage in infra and trivia, please utilize your energy for your benefit by understanding the larger debate so that each one of us can employ our energy to fix our issues. Please use your energy in a positive manner. There is no point of this discussion. It is easy to write/post arguments just to support your own application/position in line. Anybody can do that. But such narrow minded approach will not help even a single soul on this planet, including yours. For those of you who want to continue with this bickering, you can do so at the expense of your own time. And when you engage in such arguments, please remember that whatever you all write or post about this nonsensical back-and-forth is not helping you or your family. But if you are sincere and care for this issue, if you truly care for your issue, then please consider participating actively to meet with the lawmakers to make our voices heard.
Members who actively engage in the advocacy effort know when we are saying. For example – talk to nearly 125 IV members who lead the lobby day in DC during the past week. They will tell you the bogus nature of this Eb2 v/s Eb2. Stop wasting your energy arguing thing which have no meaning. Please utilize your energy in finding fix for the backlogs because there will never ever be a bill/set of provisions only for Eb3 or only for Eb2.

Does an MBA from a foriegn University Qualify for an exemption of CAP of EB2 Visas?
I was thinking one has to MS in a US university to qualify.
Thanks for further clarifying.
There are two categories of people who will qualify for the exemption
1) Any person with any advanced degree from a US university. There fore the following would qualify as examples:
a) MS in Computer Science
b) PhD in Mechanical Engineering
c) MBA
d) MS in Physics
e) MS in English
2) Any person with an advanced degree in STEM (science, technology, engineering and mathematics) from a non-US university (i.e. minimum of 18 years of education: 12 years of school + 4 years of bachelors + 2 years of masters) + minimum 3 years of work experience in US in a "related" field. There fore the following would qualify as examples:
a) 4 year bachelors + 2 years of M. Tech in Chemical Engineering from China + 3 years as a chemical engineer in a company in US.
b) 3 year bachelors + 2 yeas of masters + PhD in mathematics from India + 3 years in mathematics related field in a company in US.
3) The following as examples would not qualify:
a) MBA from a non-US univ.
b) 3 years bachelors + 2 years masters from a non-US univ.
c) Masters in English from a non-US univ.

I tend to agree. Anything that can give us positive publicity will work.
The flower campaign was a huge success. The holiday season is here and I was thinking about a potentially new and innovative campaign idea. Greeting cards with a recorded audio message to be sent to the Director of USCIS. The message would be unique to the individual sending it. Should include something like "Dear Sir - I wish you a happy and safe holiday season. My name is "xyz". I am a legal immigrant stuck in the green card backlog for "xyz" years. Please help us. This message is just an idea - it could be anything agreed upon by consensus.
Maybe this idea is a little corny but we have to think out of the box. Just imagine - hundreds of greeting cards with their own unique message - could make a point???

I am on H1b..not using EAD...also one of my buddies is working on EAD and he got his EAD renewal approved last week..i guess USCIS donot look at current immigration status to issue EAD...
I got the same email this morning and status said EAD was ordered on june 30th.
I am pretty sure we will get a 2yr EAD but will just have to wait 2 more days to confirm this.... I wonder if they are looking at the current status and if you are on h1b they are issued 1yr and processed it before june 30, while if you are currently on EAD, they kept them until June 30th.. I doubt it but just a theory...

I absolutely agree with this. All replies sound similar to me and concerned more about the illegal immigrant population. I think you will hardly find the words 'legal', 'high qualified' etc. As soon as they see/hear an immigrant, do they immediately start thinking illegal ?! I think we need to create more awareness that we exist. We need help from the media.
Done for VA.
But all the replies from Lawmakers that I am reading have nothing to say about Legal Immigration.....they have a standard reply......secure border, illegal immigrants, american jobs.....nothing about our issue.

Hi,
I had invoked AC21 and informed usc thru my old attorney.
Now Frago...is filing my EAD,AP extensions and asking me to file G28 for AP and EAD only.
They agreed to keep 485 G28 as is so that old attorney will take care of it.
Do you see any issues here?

Hello,
I am frustrated that I have to pay for an attorney for a mistake USCIS did and concerned what will happen in future when I proceed with their advice.
How about complaining to ombudsman about your situation?

[QUOTE=chaanakya;333554]3. You seem to be under the impression that IV got the visa-bulletin reversed??? Moses, wake up and smell the roses. The massive class-action lawsuit being pursued by AILA, the Silicon Valley lobby pressuring Zoe Lofgren, almost all immigration lawyers asking people to join the class action .. what about all of that? Do think your 25 bucks on the flower campaign is what got the bulletin reversed?

As Sbabunle said, the quickest way is to join a consultancy.
I am unable to figure out exactly what your *skillset* with those limited keywords, but this is a quick summary of what I can help you with:
1) Help you get an IT job (if you have IT skills). Nothing to worry about not having IT skills. All you need is basic literacy and have to learn how to copy-paste. There are some exceedingly easy jobs like Business Analyst (which are for people who don't know anything) where you would have to copy paste from word documents.
2) If you don't have IT skills, but are willing to learn, I can find mentors who would train you. I can give you a quick intro to a wide-range of technologies and the career prospects.
3) Help get you a best rate. 90% of billing rate.
4) I can even convince that consultancy to donate the rest, 10%, to IV. This is a win-win situation for you as well as IV.
Let me know what all help you need and I'd be glad to help you with anything. My ph# is on my profile. I don't know whether you can access my profile, will send a PM.
Best,
