    I would like to clarify - anything beyond 0 minutes late is rude. I have a management position in my job, and if that happens at a meeting i'd set up professionally, they get a verbal lashing from yours truly.

    I not only hear you but I have been there too. (I guess most of the volunteers have.)

    First of all, people need to realize IV's cause is THEIR cause, nobody at IV is volunteering to gain publilcity. IV is WORKING TO SAVE YOU FROM living on the edge and spending hours tracking bulletins and EAD renewal deadlines and receipt notices!

    If you don't realize this, may God help you!

    Unless you have some disorder which prevents you from looking beyond 2/3/4 years, you REALLY should be joining hands with IV so that we all are "free" at the end of those 2/3/4 years!

    If you just can't spend any time volunteering, then at least don't RSVP for such meetings! You know you would be fired if you did this at work.

    One change I noticed.

    Now people can continue in the old system if the I-140 was approved or pending before the first day of the fiscal year subsequent to the the bill being enacted. So if the bill is passed right away, you need to have filed your I-140 before Oct 1 2007.

    Not true. The wording is still the same. The date of "introduction of the act".

    I don't personally think we had much media coverage except some hidden links, can we post some paid adds where everyone can get know what we are addressing in here i.e., on the front page of google, yahoo, msn, cnn, etc. I know some people might have second thoughts as it involves $ but I'm ready for it to get public attention. There is a thin line between legal and illigal and they are ready to club both together for their benefits. I'm starting to wonder how many people know what is going on, we have to educate them first.

    If you do some more research before writing you will realize that H1C are limited to 500 visas a year and the conditions for selecting the hospitals allowed to sponsor is so stringent only 14 hospitals or so in all US qualify. Here is some more info.

    Many posts on this thread suggest that there is no H1B type visa for nurses and so they have to come on only greencard; and that is why Health lobby is trying hard to GRAB 90K unused visas (note: I consider this as a grab because from skill/CIR bills; we are trying to recapture unused visas and make them available to ALL EB immigrants rather than allocating them to one special group). But according to this news item on immigration-law there seems a non-immigrant visa H1C available for nurses. Is this true? am I misreading this?

    02/13/2007: DOL Announcement of Processing of H-1C Labor Attestations

    The Nursing Relief for Disadvantaged Areas Reauthorization Act of 2005 took effect December 20, 2006. The Act reauthorized the H-1C nonimmigrant nurses program, a program originally created by the Nursing Relief for Disadvantaged Areas Act of 1999. Under this program, eligible hospitals file attestations with the Department of Labor, Office of Foreign Labor Certification which, if approved, will support nonimmigrant worker petitions filed with the Department of Homeland Security, U.S. Citizenship and Immigration Services. The Department of Health and Human Services has informed the Office of Foreign Labor Certification that the same hospitals eligible for the original program continue to be eligible. These were listed in the Department of Labor's Interim Final Rule implementing its portion of the H-1C program published on August 22, 2000 (65 Fed. Reg. 51138). The Employment and Training Administration, under the authority of the new public law, is reinstating the H-1C labor attestation program and is accepting applications by qualified hospitals. Eligible hospitals should be advised that the now-expired OFLC form (ETA 9081), Attestations by Facilities Temporarily Employing H-1C Nonimmigrant Aliens as Registered Nurses, has not been authorized by the Office of Management and Budget (OMB) for current use. However, the OFLC will accept applications using the expired form until a new form is approved by the OMB. The attestations are made enforceable by the 2005 Act. ETA is in the process of revising the form under the OMB clearance process, and taking other appropriate regulatory action. Once approved by OMB, employers will be required to use only the new form.

    The problem of contacting media with "stories" is that you don't want people who are just hanging by a thread; just trying to stay in status and having all sorts of hardship because they want to stay. It feeds into the fact that there are a lot of people here which the country doesn't need. Discussing layoffs or threats of layoffs or employer abusing, etc., feeds into the perception from an outside person that there are too many people here not doing specialized work that an American is not able to do.


    In fact this is a very valid point ..... We should be careful about what kind of stories we diseminate into media .... If we are just giving stories in which people apperear to be grovelling to stay on at whatever cost is not good for us as I think...

    I am a Person of Indian Origin. I have a slate-grey passport-like document issued by the Indian government that says so. But I�m not really. I was not born or brought up here, and I do not have a single direct ancestor who, as far as I know, ever lived in India. I have become the proud possessor of a Persons of Indian Origin card because I am married to an Indian citizen.

    I had lived in India, on and off, for ten years�and had been married to an Indian citizen for even longer.
    Two men were seated at the edge of the sofa, looking more nervous than me. Shireen was questioning them.


    Previously, my visas were renewed every six months. We now wanted to stay in India indefinitely and make our home in Delhi. I would have preferred dual citizenship�but that wasn�t, and still isn�t, available. PIO would be second best. But the actual card was not easy to come by. It involved a total of 17 visits to three separate ministries and five different offices. It took up at least four full days of my life. I was interviewed twice, the second time at home with my wife, Shireen. The first time was at the offices of the Foreigners Division, Ministry of Home Affairs, in an unventilated, very public room brimming with non-Indians from every continent. I reached the head of the queue after two hours of eavesdropping on other people�s immigration problems. I was asked, among other more prosaic questions, to explain why I had married an Indian woman (�Love,� I said, monosyllabically), and then, with a leer and a twinkle, whether I had had many Indian girlfriends. �N-no�, I stuttered. My hesitant response did not reflect either uncertainty or mendacity on my part, but my surprise and my growing irritation with the questioner. The interview ended abruptly. He wrote �Refer for further enquiry� on my residence permit and said I would receive a home visit. �We need to be sure that marriages to Indian citizens are genuine.�

    Several weeks later, one Friday afternoon around 5 pm, I received a phone call as I was pottering around the streets of central Delhi.
    �He wanted a bribe, you idiot,� my friend said. �You�ll never get your card now; he�d have been happy with Rs 100.�


    The investigators from the Home Ministry would be at my home at 5.30. As I rushed home, images of Mr and Mrs, a television programme of my UK childhood, flashed through my mind. A gormless husband would be placed in a soundproof booth, while his bright-as-a-button wife would stand on the stage. She would be asked semi-intimate questions about their life together: what was the first present she gave him when they were ? What colour nightclothes was she wearing yesterday? And so on. The husband was then released from the booth, and would invariably get the answers wrong, to his embarrassment and everyone else�s amusement. It was gentle viewing�a mild celebration of female omniscience and male autism. But now I was going to take part in a real-life version of Mr and Mrs, and my precious PIO card, and perhaps my right to stay in India, would depend on it. And, suddenly I could not, for the life of me, remember the colour of Shireen�s toothbrush, or the name of her favourite Hindi movie, or her shoe size. Fifteen years of marriage had been erased from my memory. I was sweating with nerves by the time I reached home.

    Two men were seated on the edge of the sofa, looking even more nervous than me, untouched glasses of water in front of them. Shireen was questioning them about their professional qualifications�which were not very extensive. I gave her a self-conscious kiss on the cheek and sat down. At that point, our children burst in, a dancing duet of carefree excitement.

    �What are these children?� asked the chief investigator.

    �They�re ours.� Shireen responded with a slight chill in her voice.

    �Children of both of you? They are very old.�

    �Yes, both of us. They�re twelve and eleven.�

    �How do you have children if you are just married?� I had not prepared for this baffling line of questioning�and was later reprimanded for just sitting there with my mouth open. Shireen, meanwhile, delivered a crushing blow.

    �Ridiculous (sotto voce).... This is all totally ridiculous (out loud).... We�ve been married for fifteen years.�

    I nodded eagerly.

    The two men looked at each other, aghast, and then started scrabbling through the cardboard file they had brought with them. It became clear that they normally interviewed newly-married couples.

    �Can we see your marriage certificate?� I showed it to them and was asked for a copy. I printed out a copy of the certificate, which was downloaded on my computer. They then got up and left�abruptly ending my brief cameo on Mr and Mrs�having promised a decision within two weeks.

    The following evening, a Saturday, our cook, Pan Singh, said one of the men who had come yesterday was at the gate, asking for a lifafa, the Hindi word for envelope. I asked him to invite the man in. Pan Singh returned, a little sheepish, saying the man refused to come in, but just wanted a lifafa�with our marriage certificate. And so, slightly puzzled, I printed out another copy.

    Later, I told a friend this story. �He wanted a bribe, you idiot. A lifafa is what you put the bribe in. You�ll never get your PIO card now, and he�d have been perfectly happy with 100 rupees.�

    Three weeks later I went to the Foreigners� Regional Registration Office to hear the good news, and the bad. �Your application for a PIO has successfully passed the enquiry stage,� the official informed me without looking up. �But unfortunately, Mr Miller, all your documentation has gone astray and you will need to resubmit.� I looked heavenwards and brought my hand down rather heavily on the table. �I�m sorry. We�re not computerised yet, and some of our agents are a little careless.� It may have been my imagination, but I�m sure I detected the trace of a wink in her left eye. �Probably best to apply next time you�re in London,� she told me cheerfully. I walked away presuming, but unable to prove, that my papers had been deliberately lost.

    I took her advice. Three weeks after putting in my application to the Indian High Commission in London (no interview necessary), I had my precious PIO card�together with a 15-year visa, the right to buy property in India, and, to my amusement, the ability to join the diplomats� queue at immigration at Delhi airport. This is of no practical use, because I still have to wait just as long for my luggage, but I do get childishly gleeful as I saunter past the first-class passengers.


    Except for the presumed bribary and loss of docs, I do not see anything unusual. USCIS do a lot more grilling before issuing a marriage based GC .
    Think about the time consuming process and associated cost even for a EB GC. Well the cost is not bribe -- here they call it Attorney Fees.

    I�ve been laid off as of Friday last week.

    My employer started laying off people an year ago and there were too many cycles so far. I was immune to all those layoffs until Friday. They eliminated everybody in my team, 15 people in total.

    I am in the final stage of my GC and I have 2 year EAD. My H1 is expiring in March and my (ex) employer already paid my Attorney for the 3 year extension. They have decided to extend my H1 and paid for the expenses. But in the mean time, they were forced by the investors to show profitability and hence the layoffs.

    My (ex) employer is based in Massachusetts and my Labor Certification was done from this location.
    I have received job offers from some of my employer�s clients. However, they are based in other States (CO, OH & WA for instance) and they might not be able to do my H1. One of them is interested in hiring me on a contract basis, since they had frozen new hiring.

    Is taking a job outside of Massachusetts impact my pending I-485? or Will it violate my Labor Certification conditions? I couldn�t find an answer for this anywhere.
    Also, can I take contract jobs for the time being?

    I sent out an email to my Attorney with all these questions. But, he is not available until Tuesday next week.

    Please post your answers, comments and suggestions.

    To what one member said; we don't like it both ways. A question to the original poster. Had this been an emergency and USCIS delayed your EAD by three weeks, I bet you would be screaming and yelling at their inefficiency. Yes, the system is broken. Look at the bright side. At least an attempt is being made to fix it. If this were India you would be paying a hefty sum to God knows how many people to get something as simple as a birth certificate. And let me ask you one other question. When was the last time you picked up a phone and called your local MLA hoping that he or she will resolve the water problem in your area? Again, you would be paying decent money and runaround the MLA's private secretary to get ten minutes on the MLA's calendar.

    So dude, put-up or shut-up. Things are changing and if you want it any faster then you should give up your day job and dedicate yourself to the cause.

    Can any one of you as a single person make a difference? NO

    Can WE as a group make a difference? YES and we have proved that.

    Are WE focused as a group? Yes. In its entirety? No, and we will probably never be since we are a group.

    This mess was not created by the guy with a PD of 2007 but by USCIS. So, you can hate USCIS all you want but what did the guy with PD2007 do. He just got lucky. He got lucky, plain and simple. Why should anybody feel bad about someone else's luck?


    Come on guys, at least some of us are seeing the end of the light. Don't think I am PD 2007. My PD is Dec 2003. This is my fourth employer I am pursuing my GC with. I started working in 1997 and my first labor was filed in 1997. For various reasons I had to switch. I have seen all different cases. People who came in 2004 and got their GC by 2005. Is it fair? No, but it isn't the guy's fault. It is USCIS's and that's what we are trying to change. One issue at a time.

    This was a can't miss opportunity caused by the USCIS foul-up. Nobody could miss out on pursuing this. Now that we are done with that, I am sure core will focus on other important issues like BEC victims etc.

    I think our argument is getting a bit too emotional and thought of letting it go but wanted to respond to a few points mentioned by you:

    I was Dem leaning too, and I liked Hillary. But Obama has in no way been running the honorable campaign. He is using others to do his dirty job, if you think otherwise, you too have been sold on the propaganda of the left.

    yesterday i was reading a commentary by Karl Rove, even he said that McCain's ads went too far. I think that says enough (BTW Karl Rove is master republican strategist whose tactics are famously credited for Bush's second term win - him commenting negatively on a republican candidate and saying that ads are going too far - it wont happen everyday unless they really went toooooo far). I havnt yet seen any sleaze tactics from dem side (yet..atleast).

    when obama made a sexist remark, what did the press do? Nothing. I dont know which comment you are talking about. In presidential election time journos wait for a little gaffe and make it out of proportion - even so I dont remember any offending "sexist" comment yet. If you are referring to "lipstick on pig" comment - its laughable to see republican pundits trying to imply that is referring to Palin - he was talking about the new found "change" message and how their new campaing wont change their old policies. Incidentally McCain seems to have made the exact same comment on Hillary herself during primary season. Yeah the same press was sleeping then.
    Let us see what happens if his opposition makes a even a hint of racist remark. I am sure then that the republican campaign will be pounded by every media outlet in the country.
    Dont even mention about race. We all know that Obama's race is to his disadvantage - just ask elder white voters from south about the prospect of voting to a black candidate named barack obama - whether they say it explicitly or not we all know in our hearts that race does play a role in voting and it is to his disadvantage (I was listening to an NPR public forum where some people insist that Obama is muslim and that is their main concern - this despite of repeated clarifications from him saying that he is a christian and despite of a major controversy surrounding his christian pastor; I wonder if same suspicions would have persisted if its a white candidate named John Smith). The notion created by some pundits that Obama is trying to exploit his race towards his advantage is idiotic in my opinion. Being a racial minority myself with a strange name and an exotic religion (struggling to get a greencard :)) I know what it would have been taken for Obama to came to this stage. I cringe when people suggest that his success is "because" of his race - it is actually in spite of his race and in spite of his poor background (he came from even poorer background than most of members here I guess, he and his mother lived on food stamps for some time). Yes media might have gone overboard about his candidature at some point during primaries - but that honeymoon is long over and in fact these days McCain/Palin are getting a free ticket.

    Again, not to say I like republican ideology, I am very left leaning in my thoughts and actions. However at this time, I see that majority of the left is leaning towards Obama just for the sake of leaning towards left, and not on the merits of candidacy.

    As I mentioned earlier I am a non-voter, so dont have much stake in this election (considering my GC stage I wont be voting to either of these candidate's second term too). I was just referring to the two candidates and who is running a better campaign. As an independent observer (though slightly dem leaning as you:)) of presidential politics for last several years - I think in the last two elections - trivial/non-sensical matters overshadowed real issues and look what state the country is in. The reason for those two elections getting into trivial issues is not coincidental or is it a fluke. The propaganda artists dominate and try to "manipulate" people opinion. This time I thought it would be different and seemed different for sometime but last couple weeks the same tactics came back and they are firmly followed by McCain without even regretting. That is sad.

    If I have had a vote, I would have thought about issues like economy, war, immigration, health care, et al and decided whom to vote. Republicans know that if people think seriously about these issues they would lose - that is why they are concentrating on personalities and slowly and systematically making Obama the villain who support sex education to kindergarteners, who raised gas prices even though they are ruling for last eight years and their candidate in the senate for 30 years (whose experience they tout), etc. If personalities is the only criterion, I have to say that I like Obama more since I appreciate the way he rose out of poverty and got great education and despite of lure of earning money (whose pull is more for someone coming out of poor background) he choose to be a community organizer. McCain has a pretty good story himself but he is from a affluent family with political ambitions cultivated from beginning and was taken under wings by bigwigs from early his career - it is nothing wrong but I like a self-made man who can inspire youth and old alike.

    On expereince, just having experience is of no use. A president is someone who leads and inspires the nation - he/she does need to have enough experience to allow people judge him - being a state senator and federal senator and being in the national limelight for last 5 years and being under intense media attention for last 18 months, Obama has enough experience to allow people make decision about him. What is the use of having hundred years experience without able to inspire handful of people - lets say Sen. Sessions with hundred years of experience (not exactly but close to) runs for president does he make a good candidate??? Dont you think that Obama has shown enough leadership and inspirational fire in the primaries to be eligible to where he is now.

    Both candidates changed their positions and its fair game to discuss - its also good to discuss their stands on various issues (personally I would like to know their stand on immigration in general and EB in particular - but I am sure they both would avoid talking about that) - the thing is, last couple weeks from the time Palin came into picture - issues have taken backseat and republicans seems to be enjoining that. They seems to be following the same tactics that put them in power in last two elections (in '00 the pundits exhorting people to vote for someone with whom they can have a beer with; and then exploit voting and results in one particular state; and in '04 putting mini referundums on gay marriages while the country was in a war and then swift-boat the other candidate) and unfortunately it seems to be working again.

    It is very crucial for the members from Michigan to participate in the meeting. It is also recomended, that we find all our friends who visit IV, or are stuck in backlog, and bring them to the meeting, or urge them to become members on IV and start posting on threads....
