Hi All,
Andrew Dutton - 917-536-5940, immigration_counselor@yahoo.com is my attorney for green card. I had also used him before for H1B renewal, PERM & I-140 substitution with DOL (while case was pending with Backlog Center). He is very professional, humble, and always answers phone calls & email messages immediately. He is also very very affordable (shall I say inexpensive - see the amounts he charged me for H1B, green card processing etc below).
I was one of the unfortunate ones who got scammed my Earl David Associates (New York Law Firm) - now renamed to Jed David Philwin Associates. I know how bad law firms can be - they did not file my LC in 2003 but kept on telling me that they did - ONLY a year after in 2004 they promised me they had already done so. Needless to say how much pain suffering this caused me.
I used Andrew for my H1B + wife's H4 renewal - total attorney fees - $550. No extra fees for filing documents for family members.
Then, I used him for EB2 PERM, I-140, I-485/EAD/AP (for myself & my wife) - total attorney fees - $1600. No extra fees for filing documents for family members.
I had an existing LC approved from Backlog Center - he filed I-140 for just $100-$150 attorney fees - stating that since he had already filed a previous I-140 for me - he just needs to modify some minor details on the I-140 & file it.
He filed my I-485 over the weekend so it reached USCIS on Monday July 2 - who knows I may be one of the lucky ones when July visa bulletin fiasco is resolved.
Regarding, Philwin associates they're big time scammers...they've taken from me $5000 without giving me not even a receipt or send me the retainment and dissapeared specifically avoid fake lawyer Michael (MIKE) Venieris. I'm personally taking them to court so spread the word. Does anyone know where submit a complaint for them to the IRS and the lawyers association? However, SPREAD THE WORD so at least to take them out of the market!!

I tend to agree with all the view points expressed here. I don't think we are supposed to know every immigration details (and, I guess, that is what the immigration lawyers are for), but USCIS always will reserve the right to do anything anytime. So, I think, it is better to be educated and over cautious on such matters. It is totally USCIS' fault to issue a wrong approval (if that indeed is what happened in my case-we will find out) and I hope they make amends for it by giving me an expedited EAD and AP so I can rest peacefully (and wait, I don't know, may be another 7 years to get a "real" approval).
TravInd, please let me know the attorney you used in your case, if you don't mind sharing that information. I feel like my attorney is not very responsive.

That's not correct. Everybody pays UEI including the H1B people also. But if you are AOS status, the AOS demands you be in a job but it has nothing to do with UE benefits.

Immigration is the most contentious issue that I have worked on during my tenure in Congress. It is imperative that we first secure our borders and enforce our existing immigration laws before we attempt to implement comprehensive immigration reform. According to the Department of Homeland Security (DHS), just over 600 miles of border fence has been constructed along the Southwest border to date. In more remote areas, DHS is using tower-based integrated cameras and sensors, ground-based radar, mobile surveillance systems, and an unmanned aerial system. These initiatives are in addition to border patrol agents who are actively patrolling the areas.
I have consistently supported providing the Department of Homeland Security with the necessary tools they need to protect our country from those who seek to cross our borders illegally. For instance, in July 2009, I supported an amendment requiring the completion of 700 miles of double-layer physical fencing along the U.S.-Mexico border by December 31, 2010. This amendment follows through on the three-year-old promise made by Congress and the Department of Homeland Security to secure the border under previously passed legislation.
We must also address the illegal immigrants that are currently in our country. I will not support any proposal that provides amnesty or a path to citizenship for those that are currently here illegally. Additionally, I will continue to support programs like E-verify that provide employers with tools to verify whether or not current and prospective employees are legally allowed to work in the U.S. Since its inception in 1996, the E-Verify program has provided employers with a process to verify the work eligibility of new hires. E-Verify is free and more than 87,000 employers are enrolled in the program. According to U.S. Citizenship and Immigration Services, more than 1,000 employers voluntarily sign up to use E-Verify each week.
On July 8, 2009, the Senate passed H.R. 2892, the "Department of Homeland Security Appropriations Act, 2010." Included in this bill was an amendment, offered by Senator Sessions, which removed the sunset date on the E-Verify program, and requires federal contractors to participate in the E-Verify program. I've been on the website for sometime, started out with a positive attitude, contributed etc, but got totally * turned off* by childish posts like the one from Logiclife. Emotional responses to situations is hardly the way to lead, especially a volunteer organization like IV. Do you think big exhortations and 'quotations' from all over the web motivate people??
Needhelp, you are doing a great job. It is insincere of people to not show up after they've committed, but what's new? We've all had that happen when we try to arrange large parties where the 'not so close' crowd is expected.
My 2 cents, instead of using impersonal bulletin boards and emails, lets try this:
- you * call * 2 of your friends and ask them to commit
- ur friends each calls 2 more friends and asks them to commit
I'm willing to bet, we'll get a better turnover this way.

With due sympathy for affected folks, you really can't blame US govt for this. The law had H1B with dual intent and work constraints based on LCA and H4 as a dependent visa and not eligible to work.
Why? I don't know. Is it fair? Maybe not if you consider that L1 dependents can work but US govt did not have such provision for H1B dependents.
But that has been the law even before you got married and came here. If you did not know that you can't work on H4 then it's your own ignorance. Blame your spouse for not mentioning it to you or blame yourself for not asking that question or blame ignorance that you were not aware that would happen. There have been spouses who came here on H4, transferred into H1 because their skills were marketable (Marketable in the sense that companies (not body shops) were willing to get into the hassle of an H1B) or chose to pursue further studies, arming themselves with an US degree and made themselves marketable. Some took up unpaid internships for a while, thereby gaining experience, and when the opportunity presented itself were able to get an H1. some others took up volunteering jobs nearby.
Frankly, US govt is not responsible if you did not do your due diligence before getting married.
Now, that said, I think it would be great if H4s are allowed to work considering that so many are well educated and possibly skilled and trained. Take up the cause and enlist more people and try. Nothings impossible. Good luck.

I was Dem leaning too, and I liked Hillary. But Obama has in no way been running the honorable campaign. He is using others to do his dirty job, if you think otherwise, you too have been sold on the propaganda of the left.
when obama made a sexist remark, what did the press do? Nothing. Let us see what happens if his opposition makes a even a hint of racist remark. I am sure then that the republican campaign will be pounded by every media outlet in the country.
Again, not to say I like republican ideology, I am very left leaning in my thoughts and actions. However at this time, I see that majority of the left is leaning towards Obama just for the sake of leaning towards left, and not on the merits of candidacy. And such thing is bad for everyone concerned (even the world, because like it on not, what happens in USA doesn't just stay in USA) -- Obama has already demonstrated that he is nothing but a political opportunist. His comments on Israel (I liked his statement, but not his intention) and the eventual recanting, and among many other examples, shows that he is just unqualified to be the President.
And for the records, McCain in not running for the job just based on the fact that he was shot down. He has considerable amount of experience working in the Senate and knowledge of world issues, and American issues too.
Give me a break. McCain is running a honorable campaign and Obama is running a dishonoSrable campaign. Can you give me an example close to the "teaching sex to kinder garden" sleazy ad from McCain camp?
What is the sexiest remark? Can you explain? Media pounding on Republican? Oh yeah we saw them pounding on Bush when he ran in 2004. I remember how the media ran stories of kerry shot himself in the foot to become president. And all those pundits asking 'who do you want to have beer with' stupid questions. Obama is a political opportunist while McCain is a saint? Do you know who said this "I didn't decide to run for president to start a national crusade for the political reforms I believed in or to run a campaign as if it were some grand act of patriotism. In truth, I wanted to be president because it had become my ambition to become president. I was sixty-two years old when I made the decision, and I thought it was my one shot at the prize". John McCain. And what does he say now "Even in retrospect, he would choose the path of retreat and failure for America over the path of success and victory. Behind all of these claims and positions by Senator Obama lies the ambition to be president. What’s missing is the judgment to be commander in chief." He is your saint?
Saint or no saint, we don't want 'drill baby drill" guys and "God is running this war" nuts in the white house. You will have more problems in the economy and useless debates on abortions. We need to push them in the right direction and demand them they carry through their promises. We may not have the right to vote, but the outcome of this election will impact us and around the world.

I have had all good experiences with fragoment till now, and I have been dealing with them for a couple of years now. They were very professional i should say. Again I work for one of the top 3 financial firms , and my employer has fragomen as preferred law firm.

at least can we not take any legal action for issuing out a rule (you can file MFS and get the stimuls and then amend MFJ) on 04/14/2008??? what about people who filed a long time ago as MFJ?? Because once you filed MFJ, the action is irrevocable!?! In my honest opinion, this stupidity of issuing out a clause the day before filing deadline deserves some "stir"!!

Picture your freedom!
You are contributing a lot to your job, but are underapppreciated and underpaid. You have a business plan, venture capital and the ability to immediately start a business that will employ several Americans. You resign from your unfair employer. You go and start your business, and you start seeing it grow. Your spouse gets a new job, your children are about to go to college at a great school with in-state tuition. How is all this possible? Because you have a green card!
Are you going to give all of that up? Are you going to continue to be a minion at your company just because you are at the mercy of the unfair H1-B visa? Just curious, and thinking loud: if there is a limited and reduced number of H1B workers come in, in the long run the number of applicants for permanent residency will be shrinking too (at least EB category). To reduce EB GC applications, and preserve the americanness of the employee-pool, this seems to be a nice and covert trick, at least to me. Let few people come for 6 years, and so fewer may remain as GC holders. Maybe I am missing something here.

I guess there is very little follow-up on this issue.
That doesn't mean nothing is being done. I am continuing to do a lot of work on this, but there is nothing new to post right now.
To date I have been able to get every newspaper in the country to do stories on this, as well as three scathing editorials in the NY Times, LA Times, and Mercury News, all of which slammed the government for its action.
I have worked with the staff of a member of Congress to ensure that house representatives were aware of the issue.
As a result, the house of representatives unanimously passed the HEART Act giving stimulus payments to affected soldiers overseas.
I have been able to get an important legal organization to review and research the topic for possible litigation.
I would love to go over the legal details with you, but it is not prudent to give too much detail here right now.
And finally, I have been corresponding with immigrants like you providing advice and updates on the situation.
I am not sure what more you expect.

True. That's similar to the Canadian system and that is a good thing.
However, are the opportunities out there ? That's the question.
The US Immigration Law is a nightmare.
Couple of years ago, I migrated to Australia.
The Australian laws are very clean and straight forward. There is only one application form with some very simple question and detailed instructions. Just fill up the form, enclose the necessary documents and fees. That's it. You are done. In due time they will let you know "YES" or "NO".
There is no need to feed fat-belly hungry sharks called "Immigration Attorneys" (of course there are exceptions).
Once your case is approved, you and your family are eligible for the all the rights (except Vioting Power) enjoyed by any Australian Citizen.
Once accepted, there is no official discrimination.
Here the US Government cries about anti-discrimination, human rights etc, but those are only eye-wash. They should take lessons from the Australians.

More education generally does mean more skill. It does not always mean more pay, but this country has decided to use education and work experience as the criterion for EB category allocation.
You have put this in the best possible way. My allegiance to EB2 as I got my MS degree from US in Tech Major.

However, logiclife has indicated that there is a very good chance of CIR being debated in the Senate sometime in March so we should get ready for that now. Folks who were opposed to I-485 provision must be having a great day today. :)
