Hi,
I believe someone already asked a similar question but I just want to describe my exact situation:
- My LC (EB3) got approved on July 2007, PD is March 2007 - Company A
- My I-140 and I-485 were filed concurrently on July 2007 - Company A
- I work as a contractor and my client (Company B) is offering me a full-time job and would like me to join on Sept 2007
- I still have 4 years on my H1B
With the assumption that my current employer (Company A) will give full cooperation on my current GC process, if I join company B on H1B transfer now, can I possibly invoke AC21 later after my I-140 gets approved and I-485 is pending for more than 180 days?
I'll greatly appreciate any comments.

I dont think this means anything. With the huge influx of AP and EAD applications - I am quite certain that the last thing on USCIS's mind was making sure that the LUD was kept updated for the 485 apps. The important thing is that you have your 485 receipt and that is the acknowledgment that they have recieved the application and its in order.

Hello All,
I am currently working for Employer A for the past 6 years and my current H1 is Expiring in May End 2010. MY employer says he will file the H1 in may starting. In the meantime I got an offer from a future employer B who applied for my H1 transfer in premium processing. We got an RFE and the new employer is working on that .
My question is that lets say After responding to RFE by my future employer B , god forbid say the H1 transfer is denied. Would this denial have any impact on the H1 Extension that my current employer A plans to file in couple of weeks using I-140 approved petition. Please advice ?

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

Perm applied in May 2007 . Got audit in June . Responded within a week. No response since then. Company lawyer approached DOL 3 times checking for the labor status. No response.
Is it possible to resubmit the perm application retaining old date. Any suggestion if that might help.

Hi,
I sent my EB2 I-485 application on July 5th, 2007. Didnot receive any rejection or receipt number.
My question is can i send my wifes application immediately without getting my 485 receipt number. I have the copy of my I140 receipt number. Can i add this to my wife's application and send?
What will happen if i send without my 485 receipt number? will i get a RFE or a rejection?

I tried calling Nebraska Service Center using the 1-800 number and then entering the POJ options. But it seems USCIS has a new system in place and there's no way to reach the Service Center anymore.
Looks like they ended another means of communication---no more POJ? Please correct me, if someone knows the new options. Thanks!

If the company has 4-5 other accountants then the company should be really large with a separate accounting department or should be an accounting firm. Otherwise the question will arise as to why they need so many accountants working in-house. Should be sufficient if you list all people and provide the educational details, their are also otherways of responding to this RFE and alternative ways of responding to this particual question to show that it is common in the industry to hire people with a bachelors....etc, i would take the help of an attorney if i was in your place.
