Hi,
Am on H4 and applied for H1B in May 2006. Because of emergency, we need to travel out of US; got the approval on Sept 7th and returned to US on Sept 10th. I lost hopes of Change of Status petition approval(as one of my friend's COS petetion is rejected eventhough she didnot leave US during H1 process), but surprisingly when I received my papers today, it is approved with old I-94 number. Thank God.
Now, Can I go ahead and apply for SSN. Can they ask me to go for stamping as the I-94 on the approval notice is different from the current I-94 in the passport?

I filed my I-140 at NSC, but when I check case status online it says my I-140 was transfered to another Service center. It does not say which Service center though. My lawyer says he got all his mails form CSC, which means my I-140 is pending at CSC. Also my case number starts with WAC-XXX-XXXX, which also suggests that my case is pending at CSC. However, I am not convinced if this is correct because CSC does not publish processing times for I-140. Also, recently when I filed AR-11 for an address change I got an email from USCIS with the address of TSC on it. I would like to know if anyone is in the same boat and knows which service center there case is. I will appreciate your feedback.

My sister's H1B petition was approved on 2008 and she was unable to travel US for the past 1.5 year.
She is working in a MNC company in India. Now, she came to US on her B1 visa 1.5 month back. Meanwhile, she got an offer from a client in US and she want takeover the new job on her approved H1.
So, can you please let me know whether the employer (whoever filed my sister's h1) can file the H1B amenment while she in US with B1 visa and having H1B approved petition? If so, how many days she has to wait to get the approved amenment to start her work at client place? The employer is going to do the premium payment so that can we assume the amenment will be approved for sure?.
The LCA is really required for H1amenment? Please advice. This is really urgent.

Hello All,
I am an Indian citizen and a Permanent Resident of Canada. My Fiance is a US Citizen and we're planning to settle down soon. I also have a valid 10 year US B1/B2 Visa.
I know that if one marries a US Citizen you can get US Green Card but I am not sure about the processes. I want to know what is the best procedure so that I can be in the US quickly and also have my green card.
I know there is something known as Fiance visa but I'm not sure how it works.
Can anyone please elaborate and guide me into this situation.

Hello, I apologyze for not giving my name away first of all, secondly I need to know what my options are if my father and mother who are permanent residents in the USA can file an I-130 for me? They obtained their legal status thru the department of labor but at the time they were approved I was already 21 years of age (the whole process started in 2000and lasted for 5 years or so); one lawyer told me that I cannot do anything since I was over 21 but I just have been in a different lawyer who told me that yes I can adjust my status thank to a grandfather law that can help me to achieve my goal in working legally in this country. I am an unmarried daughter and 27 years of age at this time.
I just don't want to spend those $5,500 can this lawyer is asking me for his services, I appreciate very much your replies and my family will too

I have 3yrs degree(Microbiology) and one year postgraduation diploma in computer science and 9years of work experience, Can I apply on EB2, some peolple saying at I-140 stage it gets problemetic with your degree, my employer says you can eligible to apply on EB2, Iam in real dilama, can any one please help me... thanks
I tend to think that your I140 in EB2 will be a problem. Specially so if your filing center is Nebraska. They have a reputation to be very very strict. Ask your employer if he has previously approved cases for people with your background.

This evening, news media outlets are reporting that Solicitor General Elena Kagan will be the nominee to replace Justice John Paul Stevens on the US Supreme Court. Kagan was asked last summer by the Supreme Court to opine on whether the high court should hear a challenge to the constitutionality of the 2007 Arizona employer immigration sanctions law. Kagan has so far not provided an answer and she'll no doubt be asked about this. She'll also likely be asked about the new Arizona law.

You EAD or AP may be approved at anytime while your 485 is pending, it is a derivative benefit of the pending 485 petition. If the 140 is rejected then everything collapses like a stack of dominos.

If your 'temp stay' implies staying in a hotel and flying to Chicago on the weekend then no. If it means that you have leased an apartment and plan to stay in NY for a few months then sure go ahead and fill it out.

I have paid the fee through my credit card and the status of the transaction is showing as "Pending" in my bank account. I can able to see "MRV Fee Receipt Number". i can also able to see Schedule Appointment First Available: Friday, November 12, 2010 09:30 AM. But I am not able to schedule an appointment. All of the steps I performed on Yesterday. So I have waited for today for any changes and all remains the same.
Please help me.

Yes its a new rule,is it possible to make passport for her(unmarried) instead of married and go for stamping oh H4,does it create any problem for stamping?
