Hi Gurus,
My PD is Aug 2005 (EB2 India). Last year, during September - October my case was picked up and I think it is processed, but because of lack of visa numbers, the case was not approved. (I wrote a senator letter, he got back saying that the file is processed and waiting for visa numbers)
Now, I got 2 offers. First one is a fulltime position and 2nd one is a contract with a primary vendor (directly working on W2 using EAD). I haven't decided which one to join.
What are the options, I have? Do I need to file AC21? Since my file is already processed and waiting for the PD to become current, am I OK, even if I don�t apply for AC21? If I file AC21 and if the job descriptions are not matching or because of any other issues, if there is an RFE, I will be having some issues.
Gurus please let me know your thoughts.

Can i cancel appoinment one day before.
I saw in www.vfs-usa.co.in website ,have to cancel before two working days of appointment day.
If i cancel appointmentafter few days will i have to fill again DS156,157 forms for appointment.
In website they said cant cancel appointment 2 times.After 2 times cancelation have to wait 90 days with that hdfc barcode.
Before 90 days period can we fix new appoinment by paying agian into HDFC bank.Is this possible new appointment with new barcode.

Keeping in view the current and anticipated situation in Oct 2007, would priority date transfer help me at all or I will have to face same processing times?
My assumption is that visa numbers will be unavailable from Aug 17th to Oct '07 and when the new visa number become available, the dates will retrogress to 2003 or 2004 ... who knows. So using old PD may earn me advantage in that case.

my company have applied for H1-B & H4 extension for myself and my wife. My wife now is looking to go for work and has got an offer from a company. The company will be doing a premium processing of my wife's H1-B and it is expected to be approved in 2 weeks. my wife has already held H1 status before, so she doesn't fall undr the cap. If my wife's H4 comes thru later, what status will she hold?

My H1B Visa stamp expires in Jan 08 but H1B Status expires Sept 08. Is it too early to get a new H1B stamp 4 months before expiration of the H1B stamp I currently have.
I am planning to go to Ottawa now for a stamp that expires in Sept 08.

Visa stamp doesnt define your legal status or your stay period ,it is the latest I 94 . Visa stamp is only required when u travel outside the country.

The restrictionist Center for Immigration Studies has put out a DREAM Act proposal that could tell us what the Republicans might propose when they re-draft DREAM to their own liking. It's not horrible - some ideas, particularly those in the first of the two parts - would probably be areas where agreement could be reached. I'm a long time silent follower of these forums. I've been thru most of the ups and downs of the immigration journey, and I am now on the final stage of the green card waiting for my PD to be current.
Something rather curious happened to me that I would like to share with you. I recently applied for my first EAD, about a full year and a half after I filed for my I-485. My e-application and consequently the receipt date is Nov 3rd, 2008. I got my biometrics notice in the mail on Nov 14th, for an appointment date of tomorrow, Nov 26th.
The oddity starts here, I just went to check my mail, and I am already approved for my EAD, and the card production has been ordered.
Is this something that happens frequently? Has it ever happened to anyone else before? I will be showing up to my appointment tomorrow anyway just in case...

I am Canadian Citizen, born in India. My Father, USA Citizen filed I-130 for married son during FEB-2003 and approved. I am here in USA since 2006 working on TN, current status will expire in JAN-2013. Waiting for PD to current for my F-3 (Family), this month PD is 01JAN01.
Questions,
1. I can see now PD is moving fast, any idea, how long it will continue this trend? Since all know huge backlog making impossible to assess anything.
2. What next? filing I-485? and I-846 support letter? anything else?
3. How long this procedure will take in typical case?
4. While applying for Citizenship, did my legal authorized stay in USA count? or zero counter begins?
5. How do I get work authorization for my son in University? or for my wife, now stay home? Available any alternates?

Can we file PERM with a photocopy of Passport that is about to expire in 3 months.
Is it advisable to get passport renewed and then file it or it doesn't matter? My lawyer has asked me to submit copy of my passport along with other document that will go with the PERM application. Just wondering if my lawyer files PERM after expiration date (mentioned in the passport copy) has passed (due to delay in paperwork etc). Or what if lawyer files before expiration date but case is reviewed by DOL/USCIS after expiration date is passed?

Hello,
My wife changed her status from H4 to F-1 while in USA. Now due to family situation, she wants to travel to India. She is on OPT now and working for an IT company since Apr 10.
She will be going for her first F-1 stamping. I know it is risky to go for F-1 stamping while on OPT.
a) What are her chances of get F-1 stamping?
b) What measures should we take that will increase her chances ?
If any body had similar expeince please share here.
Attorneys or any one please guide us in this regard.

My spouse qualifies under cross-chargeability, she filed her I-485 application after mine, with me as the primary applicant. I never mentioned anything about cross-chargeability in my application.
Now the PD is current for "all -other chargeability" how do I check if my I-485 application is going to be picked up?
Any ideas how I can do that?

Cute is out; conciliation is in. Late-night talks with Republican moderates intensified last week on the Democrats' signature health- care initiative -- extending coverage to millions of working class children. Staff negotiations continued during the holiday weekend, and Georgia Rep. Nathan Deal, a Democrat-turned-Republican with expertise on health and welfare issues, has been invited in by both sides as a broker.
House Appropriations Committee Chairman David Obey (D., Wis.) last week abandoned a confrontational plan to pair defense and education budgets, which would have dared the president to veto both. Instead the two bills were sent separately to Mr. Bush, who could veto the education measure as early as today. Looking ahead to the override vote, Mr. Obey took care to preserve House Republican provisions regarding abortion, child vaccines and abstinence education.
The House is scheduled Thursday to take up an antipredatory lending bill that is a showcase of cooperation between the chairman of the House Financial Services Committee, Rep. Barney Frank (D., Mass.) and his ranking Republican, Rep. Spencer Bachus of Alabama.
"He called up and said why don't you come down to my office and tell me what you need to be on the bill," said Rep. Steve LaTourette (R., Ohio) of his own dealings with the chairman. Mr. Frank is a close ally of House Speaker Nancy Pelosi and has urged Democrats to permit more Republican amendments as a way to change the political tone in the House.
"It's transactional -- you have to see what it brings," Mr. Frank said. "But Hubert Humphrey once said, 'Whenever I get cute, I blow it.' That's the same thing I'm saying: if you try to be too political there's a backlash."
That backlash is evident: Congress's approval rating has fallen from 31% in March to 19% this month in the latest Wall Street Journal/NBC News poll.
A year after returning to power, House Democrats are at a crossroads. The party's early agenda -- tougher ethics rules, a minimum-wage increase and more aid for college students -- is largely in place. To go further, the majority must overcome not just presidential vetoes but the often-crippling partisan bitterness left from 12 years under Republican rule.
The war in Iraq, which permeates Washington and again divides the House this week, makes that cooperation harder. As the president lays down vetoes, he seems to prefer a divided Congress that poses less of a challenge. And the Senate's filibuster rules, which require a 60- vote supermajority just to get a bill to the White House, are an added frustration for House Democrats.
Allies of Ms. Pelosi said she could do more to take the lead and soften the tone in the House by using her power over the Rules Committee to allow more Republican amendments.
Last month's floor fight over the Foreign Intelligence Surveillance Act -- a controversial arena relating to the government's wiretapping activities -- is a case in point. The Rules panel disallowed all 27 Republican amendments. The minority retaliated with a procedural motion that successfully forced the bill to be withdrawn, and it still hasn't come back up for debate.
Ms. Pelosi's combative nature doesn't make such a shift easy. When the president recently accused Democrats of being led from the left by the anti-war group Code Pink, she saw it as a slight on her and responded in kind, saying Mr. Bush was acting less like "the president of the United States" than a "a junkyard dog on television every day because he has nothing to produce."
Going into 2008, the Californian said her party is well positioned on the issues most important to voters. Democrats think the child health-care fight is a long-term winner with bipartisan appeal. Party polls show her next priority, an energy bill that demands that cars be more fuel efficient, would appeal to independent voters. And tougher safety standards for imports from China is a third bipartisan issue that Democrats hope will improve Congress's image and is a reminder of Ms. Pelosi's early human-rights record on China.
"Nothing is a setback, we're going forward," she said, sitting in her Capitol office.
Ms. Pelosi's tough style borrows from her hero: the late Speaker Thomas "Tip" O'Neill of Massachusetts. Another Boston politician, and an O'Neill ally, Joseph Moakley, may be more relevant in Ms. Pelosi's predicament.
