The State Department has released a report showing the increasing number of people with approved immigrant visa petitions at the National Visa Center who are waiting for their visa numbers to be current. The number is about three and one-half million. Given that our immigration laws permit only 376,000 people to immigrate to the U.S. each year under the family-based and employment-based preference systems, the average wait is over ten years long. Guys,
I had received FP notice 2 days ago and my FP date is after 3 weeks. I was getting ready to try to do it early but I just received Card Production Ordered email for both my spouse and myself. What do I do now? Do I need to still go for the FP after 3 weeks.
I am not sure why they would send me the FP notice if they wanted to approve my GC.

With regard to export compliance, the new Form I-129 includes a new Part 6, entitled �Certification Regarding the Release of Controlled Technology or Technical Data to Foreign Persons in the United States� which requires petitioners that seek to employ foreign nationals in H, L, and O nonimmigrant visa status to certify that the company (i) has reviewed the Export Administration Regulations (�EAR�) and the International Traffic in Arms Regulations (�ITAR�), and (ii) made a determination as to whether or not an export control license is required to release any controlled technology or technical data to the foreign national.

Has anyone contacted senators in NJ and got any response? I contacted them through regular mail filling out the forms from their website and enquiring on my pending 485 but haven't recived any response from either of them yet. I sent my papers on Sep 2nd and haven't heard anything back.

H-1B visas are a relatively swift path to employment for foreigners with bachelor's degrees and U.S. employers to sponsor them. Each year, the U.S. government makes 65,000 H-1B visas available to qualified individuals on a first-come basis. The cap has been reached every year for the last several years, and for fiscal year 2008, it was reached on the first day of filing. As of July 10, 2009, U.S. Citizenship and Immigration Services (USCIS) had received 44,900 H-1B cap-subject petitions that have been counted towards the 65,000 H-1B cap. USCIS continues to accept cap-subject petitions.

I think once the I-140 application is filed based on the state of residence, USCIS can transfer it to any service center. The applicant doesnt have any control over it. As far as I know, the applicant cannot request for a change in service center.

Hi,
I got my labor approved couple of weeks back and now attorney is filing I-140. My situation is
Job 1 : Worked from July 1st 2006 to Oct 2nd 2007 (Laid off on that date and h1b was not cancelled ever after)
so applied for h1 transfer immediately, USCIS received application on Oct 9th 2007 (Regular processing)
While I was waiting on that, I got another fulltime job in Nov, Applied for h1 through this company (Premium processing) and got approval within a week, started working from Nov 15th 2007 to till date..
In Decemeber 2007, I got approval for pending H1b from 2nd compnay too.. but never used as i was already working for Company 3.
So, In my labor requirement it was M.S. and 1 yr relevant experience, Labor approval showing employemnt history as
Job 1 : July 1 2006 to Oct 2 2007
Current Job : Nov 15th 2007 to till date
Is it a problem if it shows 1 month gap between these two jobs?

You just need your approved EB3 I-140 notice
You need a copy of the approved EB3-140. Original is not required and you will not get it either. A copy should be available but depends on whether your employer/lawyer shares documents with you or not.

Our Application was also received by M.Salcedo at TSC on August 2nd. We got all our receipts on October 1st. When I checked the status online for 765, the status showed - 'Card Production Ordered'
