Hi,
I talked to my lawyer and she didn't mention about any kind of delay so can you please give me some more details about this PIM and how does it affect the whole process and slow things down.

scorion PIM process is a new additional step that is now part of visa stamping process. if you read around here you will find out more about it but in short uscis office in kentucy has to scan and upload all your supporting documents i.e employement letter etc that you might have used to get an H1 approval. The embassy you will visit for visa stamping has to review all the uploaded doc's before stamping your visa. Now I read in one of the thread here that someone in chennai has been stuck for over 3 to 4 weeks after their visa intvw just because the PIM process is not done. Hope this helps. My husbands DL expires on Oct 1st, 2007. The North Carolina DMV insists that he should have a valid H1B visa stamp in his PP in order to renew the license. He does have a valid H1B extension with I-94 at the bottom till Oct.2009. We dont want to leave the country as we are filing for our I-485's.
Any one in NC have any suggestions?

First of all i want to say is nixstor cool down, you dont have to use bad words to say anything, even though you spell wrong people can read it right.
The whole name check system itself not working properly, everybody knows it, there are criminals who got clearance and there are innocents stuck for years, so its a chance to make FBI think about their system.
Yeah, tell me the same thing when all of us will wait for 6 or 7 years if they dont fix the system and continue to do security check on us. We know that we are NOT bad people. Its difficult to prove that in existing conditions. People are paranoid about every thing right now.

It is certainly a good deal that we are able to file for 485 and we can enjoy the benefits of EAD/AP.
Mark my words...when apply to renew your EAD and you are not sure if spouse can work when one EAD has expired and the other is in the process of being approved you will realize what we are trying to say...after you keep applying to renew AP/EAD 3-4...one beings to wonder if it was all worth it.
In short, after we file our 485/EAD/APs we should work with IV and try to lobby for better laws...we should not be complacent and think our work is done, we crossed a small hurdle thats all.

Folks,
Anyone having experience renewing DL in Ohio after filing for I-485? Do they issue DL for 4 yrs? Or do we need to apply for EAD (if H1B is expiring and company is not willing to apply for H1 extension) and DL will be issued till the expiry of EAD?

Numerous students on F1 visa applied 485 and got their GC these years.
One's I-485 can be filed only for visas with dual intent status. For instance, an F visa or a B2 visa person (currently not dual intent visas) cannot apply for I-485. This was the basis on which I made that statement. Everyone is free to interpret differently. Again, I am not an attorney and I might be wrong.

I am a July 27th filer, got email that AP approved Dec 20th. Not recieved it physically yet.
I filed on July 27th as well, but have received nothing. Not even a LUD. I have travel plans for Feb 2nd. All reservations done, ticket issued, leave approved, but still no AP:mad: What should I do:mad::mad::mad:

Yes, Can open an LLc or Inc even on H1. Make sure you look at tax laws in your state. A non operating entity also has to pay about $750/yr in Taxes (Varies from state to state) plus file annual reports etc all costing more $$$.
So think it through before incorporating.

People, most of us here are just afraid that they will get red dots, be ridiculed for their beliefs. But the things is; If we don't fight for our rights, who will. We have to defend our place in the queue, which at the moment is at substantial risk.
I want everybody to get their GCs. but now interfiling/porting is hurting out position in the queue.
If you are not aware, a good bunch of EB3s are now trying to interfile & port their PDs which are between 2001 - 2005 to EB2.
This will potentially put tens of thousands of people in the EB2 queue before most people in EB2 who are waiting.
These people were not eligible for EB2 when they filed their own labor.. so they should NOT BE ALLOWED TO PORT THEIR OLD PDs. Sure EB3 can Interfile .. but you will get a new PD ... the date you interfile.
If we just keep looking... there will be a huge retrogression in EB2. And its not like these EB3 people will get through with the interfiling/porting. Most of them will be issued RFEs. Their labor apps will be audited and their primary EB3 apps will be cancelled. Infact, 85% of interfiling will never successfully make it through. And its not like it will help the EB3 brothers. That queue will still be long... because they are not going to withdraw their EB3 apps.
Also, while they will not succeed in interfiling/porting, they still will have their apps with USCIS and USCIS will sit on them before eventually issuing NOID. Sad part is they will count these when giving numbers to DOS for setting visa bulletins.
This PD porting is the last "not so ethical & legal" thing after labor substitution.. that we need to Put a cork on.
If we don't act now... then we can all expect to stay in AOS for the next 5 years. This holds for both EB2 and EB3.

But anything that threatens my position in the queue is not acceptable.
