I believe some top-level IV core members are EB3-I with PD 2003-04. So it is hard to believe that they are not worried watching "U" month after month and don't want to do anything about it. But as IV-Core they can not just do something for EB3-I. We need to find a way to fix this issue without creating another subgroup for EB3-I and take advantage of IV movement.

The status of AP seems to be changing practically everyday. The message (document mailed) first appeared on Jan 7, Then changed to Jan 8 with same message and today I see a date change in my portfolio (last updated section). Not sure when the document will actually get mailed...

I looked up the link http://judiciary.senate.gov/schedule.cfm and it indicates something else. However, there is a remote possibility that CIR might be discussed as one of the witness is congressman james Sensenbrenner who was the sponsor of the house bill. Lets keep fingers crossed:)

My attorney received a letter from DOL 11/21/2005 noticed the case closure, replied the next day mentioned this is an error to close this case.
FedEex another letter to DOL to reiniate reopen this case on 11/29/2005.

This bulletin does prove that very few labor certificaions were done in 2005, due to move to PERM.
And those who had applied in PERM in 2005, got their GCs already..
I know a few who applied in PERM as soon it was introduced and got their

I am still on H1 (not utilized EAD), the visa on my passport expired last year. Planning to visit India next week, should I be getting a visa stamped or use AP?
APPRECIATE INPUTS FROM THE EXPERIENCED/SIMILAR SITUATION. Any USCIS link will also help.

Well my friend people here will tell you that once you use AP your h1B is not valid any more thats not true. I confirmed this with 2 Immigration officers and my attorney. AP and h1b have nothing to do with each other. One is an entry permit the other is to work with a specific company. no link so use you AP at re entry when IO ask why did you go to india don't say vacation. thats all.

filed LC in 2003 thinking it would be useful to stay on H1 as long as possible!! and the rest is on my profile..
I wonder if anybody thinks it makes sense to create a law which simply says after 15 (or some X years) of legal presence in the US you will be given a GC no matter the back ground! In that way we know exactly where the deadline is irrespective of some government agency's whim.
to make it more arbitrable, how about if one completes the 40 tax credits and is clean of criminal records.

Today I got a LUD on my AP. Documents mailed. Finally after 2 weeks of waiting time. Nebraska center is slow really slow. But I am happy can now go on my business trip.

Today I got my first soft LUD on my case. Last week I got a letter from USCIS that they had approved to expedite my case. I would rather have seen the AP but the waiting game continues. :eek:

I came here at an old age compared to most of you on this forum. Now I have two kids in college and a third one waiting to enter next year. This is my sixth year here and I have no immediate plan of returning to my home country.
Having a GC will ease the financial burden of seeing my kids through college. Thereafter, we plan on starting a family business that will export technology to my home country (all my sons are studying computer engineering) where opportunities are increasingly available for such ventures.
My wife and I plan to retire and go back home (by which time I hope we would be US citizens). Towards that end we are building our retirement home in Nigeria. As for my sons, I have given up hope that they will ever return to Nigeria to live!
I have two brothers who are already US citizens and have filed for our parents so I don't miss being with my parents as they come and go as they wish.
So to me, the value of the GC will be to eventually get US citizenship, retire and be able to get my social security and medicare and finally go back home with the ability to visit my kids and grand kids in the future.

Thanks a bunch for all of you who contributed today, I read each and every post and felt very content that atleast there are people who feel the same way like I feel. IV is the only org that stands for us. Feb 07 2008 I made an infopass appointment and saw an IO he accepts my request to expedite. Finally I get a LUD saying Documents mailed to applicant on Feb 20 2008. Then on feb 21 2008 I see a soft LUD Till today I have not received the AP. Do you thinking making an infopass appointment and requesting a copy will help. The problem is I should have been in Canada on the 9th. I don't know what else to do. This is ridiculous. Gurus please an suggestions:mad: This case was filed with the Nebraska Service center.
