the LCA needs to be done for any H1B or when the job is in a new location. it doesn't take long to get that submitted (<1 day) no need to go stamping. it doesn't cost any money to submit a new LCA

hI ATTY I am working under an h1b visa right now as of 2011. But i had a previous petitioned by another employer way back 2006. There was an I-140 filed but it was denied and I never heard from my petitioner then. I do have the USCIS copy and case number. Can I look for another employer and atty that could reopen the case?? Please help me. Thanks

They don't verify anything. They ask you to fill in a form I don't remember the form number. I remember they were asking your full name, SSN, Address in US, Country of citizenship, place of birth, your father's and mother's first name.

Hello,
I have just got my green card and I am filling out I-130 form for my older son who was 21 when I submitted my I-140.
My question goes to point 16, "Has your relative ever been under immigration proceedings?" as I am not sure what to check over not knowing the terms (Removal, Exclusion/Deportation, Rescission and Judicial Proceedings).
I am asking that as my son has been denied admission in the US last summer. He had an F-1 visa (through 2014) but changed schools, got another I-20, went to the US Embassy in my country, the Embassy denied him a new F-1 visa but they didn't stamp with "Cancelled" the F-1 visa in his passport so he thought the visa is still valid, returned to the US but in airport he was not admitted entrance and had to fly back to our country.
Sorry for my long explanation I just want to find out if what happened to him falls under one of the 4 Immigration proceedings under article 16 in I-130 form.
I want to get him here not have him banned for ever for not knowing correctly the terms.

Since this is not criminal in nature, I dont think u will have much of an issue. But just for ur peace of mind, why dont u just call ur immigration lawyer and ask, i mean if u have one

Also I have read conflicting responses e.g. some users have suggested not working and other have said you can work 180 days after EAD expires.

I just received an 3 year h1-B extension based on an approved I-140. I had only 2 years left of 6 year h1 limit but because I have an approved I-140, I got one more year.
I attached my approved I-140 copies along with H1B extension application but the Alien number A# on this new H1-B extension approval is different than what I have on I-140 approval notice. Actually its a typo, instead of A 08 it A 008 and because of one extra zero the last digit is lost.
Is this a matter of concern? Please help.

When applying for my H1B petition in April 2008, my lawyer had mentioned that I would be going to the US embassy in Germany for the H1B visa interview. I'm also aware that I could go to my home country for doing the same. However, does anyone know if I can go to Canada/Mexico, given that I have the visas to go to these countries ? I have a US H4 visa.

I re-entered the country using Advance Parole. I applied for H1 extension after the reentry and I have the approval notice with the I94 attached to it.
EAD renewal questions:
Manner of last entry - I think it should be Advance Parole
Current Immigrant status - Not sure if it is Parolee or H1?
Please help and reply if you have filed EAD in same case and got approval. Thanks in advance.

As per Murthy's site, we can apply for an interim EAD after 75 days of filing. Has anybody had any luck in getting Interim EAD from local USCIS after 75 days. Do they encourage 75 days period to get EAD. Pls let me know.
